HomeMy WebLinkAboutCC RESO 93-64RESOLUTION NO. 93-64 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE MAYOR TO EXECUTE AN AGREEMENT WITH THE COUNTY OF SAN DIEGO, PERTAINING TO ESTABLISHMENT OF AN INTERIM SOLID WASTE COMMISSION, AND PROVIDING FOR THE DISPOSAL OF SOLID WASTE ("INTERIM AGREEMENT") WHEREAS, the City of National City has for many years disposed of the solid waste collected within the City by deposit of said waste into landfills owned and operated by the County of San Diego; and WHEREAS, the County of San Diego has requested the City of National City and other incorporated cities within the County (with the exception of the City of San Diego) to enter into a "Participation Agreement" to commit their solid waste to disposal in County landfill facilities; and WHEREAS, SANDAG established a committee of city and County officials from throughout the County to study the issues involved in the proposed Participation Agreement, and said committee has prepared and recommended approval of an agreement referred to as the "Interim Agreement"; and WHEREAS, the stated purpose of the Interim Agreement is to provide a committed flow of solid waste to the County to enable the County to issue bonds to finance the expansion and/or closure of the San Marcos landfill and to provide financing for other necessary solid waste system projects; to provide a process for up to 12 months by which the parties can participate in dealing with regional solid waste matters; and to develop a permanent governance authority to deal with regional solid waste matters to promote the long-term health and safety of residents of the County and the cities therein; and WHEREAS, the Interim Agreement will take effect on June 1, 1993, provided that the County and each city has approved and executed the Agreement; and WHEREAS, the Interim Agreement establishes an Interim Commission consisting of one commissioner from the County of San Diego, who shall be a supervisor, one commissioner from each member city, who shall be a mayor or council member, and one ex officio commissioner from the City of San Diego, who shall be a mayor or council member, and provides that Commissioners shall be appointed by their respective governing bodies which may also appoint an alternate commissioner; and Continued on Page Two Resolution No. 93-64 Page 2 of 2 WHEREAS, the role of the Interim Commission shall include providing advice to the Board of Supervisors concerning capital projects in excess of $50,000, disposal alternatives if the San Marcos site is closed, other disposal options, outside of county disposal, intracounty transfer of solid waste, and tip fees, and consideration of alternative organizational structures for exerting a unified effort to accomplish solid waste objectives; and WHEREAS, the Interim Agreement contains a "Flow Control Covenant," which provides that to the extent allowable by law, each member agrees to deliver to the facility reasonably designated by the County between 50 % and 100 % of its "acceptable waste," which excludes recycled material. NOW, THEREFORE, BE IT RESOLVED by the City County of the City of National City that the Council hereby authorizes the Mayor to Execute an Agreement with the County of San Diego, entitled "Agreement By, Between and Among the County of San Diego and the Cities of the County Establishing an Interim Solid Waste Commission and Providing for the Disposal of Solid Waste ("Interim Agreement"). Said Interim Agreement is on file in the Office of the City Clerk. BE IT FURTHER RESOLVED that pursuant to the provisions of said Agreement, the City of National City hereby commits 100 % of its acceptable waste to the County of San Diego.
