HomeMy WebLinkAboutCC RESO 93-75RESOLUTION NO. 93-75 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY APPROVING THE SALE OF REAL PROPERTY AT LESS THAN FAIR MARKET VALUE TO EFFECTUATE THE PURPOSES OF THE NATIONAL CITY DOWNTOWN REDEVELOPMENT PLAN WHEREAS, Charles B. McLean and Reina A. McLean, Trustees of the McLean Family Trust under Trust Agreement dated May 6, 1987 (hereinafter referred to as the "Redeveloper") are acquiring the real property located at 2202 National City Boulevard (hereinafter referred to as the "property"); and WHEREAS, said real property is located within the Project Area of the National City Downtown Redevelopment Plan, established by the City Council on December 1, 1981, pursuant to Ordinance No. 1762; and WHEREAS, the Community Development Commission of the City of National City (the "CDC") desires to benefit the Project Area by assisting the Redevelop- er in the establishment of an automobile dealership on the property devoted primarily to the sales and service of new automobiles; and WHEREAS, the Redeveloper has represented to CDC that they have the experience and qualifications to successfully establish and operate such an automobile dealership; and WHEREAS, the CDC is authorized, pursuant to Sections 33339-33340 of the California Health and Safety Code, to participate with property owners within the Project Area to redevelop their properties; and WHEREAS, the Redeveloper has requested the financial assistance of the CDC in establishing the proposed automobile dealership within the Project Area, and the CDC is willing to grant the requested assistance upon the terms and conditions set forth in the documents entitled "Purchase and Sale Agreement and Joint Escrow Instructions," and "Disposition and Development Agreement and Promise to Pay" which are on file in the Office of the Secretary of the CDC; and Continued on Page Two Resolution No. 93-75 Page 2 of 3 WHEREAS, pursuant to the aforementioned documents, the CDC will acquire the property from the Redeveloper, and will resell the property to the Redevelop- er, with Redeveloper having the opportunity to satisfy the payment to the CDC of $500,000 of the sale price by complying with specified performance covenants; and WHEREAS, pursuant to the provisions of the Grant Deed of the property from the CDC to the Redeveloper, the Redeveloper is bound to certain performance standards with regard to development of the property which, if breached, afford the CDC the opportunity to recover title to the property; and WHEREAS, the CDC is authorized pursuant to Section 33433 of the California Health and Safety Code, to sell real property acquired with tax increment moneys at less than fair market value if, after a public hearing, the City Council of the City of National City determines that the lesser consideration is necessary to effectuate the purposes of the Plan; and WHEREAS, the City Council of the City of National City provided public notice and held a public hearing on June 15, 1993 to consider whether the sale of the property at less than fair market value is necessary to effectuate the purposes of the National City Downtown Redevelopment Plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of National City that the City Council does hereby find as follows: 1. That the sale of the real property at 2202 National City Boulevard, National City to Charles B. McLean and Reina A. McLean, Trustees of the McLean Family Trust under Trust Agreement dated May 6, 1987, at less than fair market value is necessary to effectuate the purposes of the National City Downtown Redevelopment Plan. 2. That said sale will further the objectives of the National City Downtown Redevelopment Plan by providing employment opportunities, maintaining a sound economic base, and by bringing additional sales tax revenue to the City of National City. That said sale will further the land use objectives of the National City Downtown Redevelopment Plan by assisting in the establishment of another new automobile dealership on the "Mile of Cars." 4. That said sale will further the objectives of the National City Downtown Redevelopment Plan by causing an increase in tax increment for the affected real property in the amount of approximately $10,000 per year. 5. That said sale will further the objectives of the National City Downtown Redevelopment Plan by ensuring that the new automobile dealership will locate and remain in National City rather than in another location. BE IT FURTHER RESOLVED that based on the above findings, the sale of the real property at 2202 National City Boulevard to Charles B. McLean and Reina A. McLean, Trustees of the McLean Family Trust under Trust Agreement dated May 6, 1987, at less than fair market value is hereby approved. PASSED and ADOPTED this 15th day of June, 1993. George H.
