HomeMy WebLinkAboutCC RESO 93-113RESOLUTION NO. 93-113 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING EXECUTION OF ORDER TO VACATE AND CLOSE A PORTION OF UNIMPROVED RIGHT-OF-WAY ON THE EAST SIDE OF EUCLID AVENUE, APPROXIMATELY 410 FEET SOUTH OF 20TH STREET. CASE FILE NO. SC-1993-1 WHEREAS, the City Council of the City of National City adopted Resolution No. 93- 71 on June 15, 1993, declaring its intention to vacate and close portions of unimproved right- of-way on the east side of Euclid Avenue, approximately 410 feet south of 20th Street, more particularly described in Exhibit "A" attached hereto and incorporated herein as though set forth in full, and WHEREAS, the City Engineer of the City of National City, California, has caused notice of said vacation and closure to be posted in the manner specified by law, and WHEREAS, the Planning Commission of the City of National City, California has considered the proposed vacation and closure and has found and determined that the said, proposed vacation and closure of unimproved right-of-way on the east side of Euclid Avenue, approximately 410 feet south of 20th Street, is in conformity with the City's adopted General Plan, and that said portion of public right-of-way is not useful as a nonmotorized transportation facility, as defined in Section 156 of the Streets and Highways Code of California, and is not needed for present or prospective public use, and WHEREAS, the City Council has considered the Planning Commission's report and recommendation, and the presentation of staff regarding the proposed vacation and closure, and WHEREAS, all things and acts necessary to be done as required by Part 3 of Division 9 of the Streets and Highways Code of the State of California in order to abandon said street have been done and accomplished, and WHEREAS, a hearing was held on July 27, 1993 in the City Council Chambers of the City of National City, at which time all persons interested in or objecting to the proposed vacation and closure were afforded the opportunity to appear and be heard, and WHEREAS, the City Council at said hearing, found, from all evidence submitted, that said portion of public right-of-way is unnecessary for present or prospective public street purposes, and is not useful as a nonmotorized transportation facility, as defined in Section 156 of the California Streets and Highways Code; and CONTINUED ON PAGE 2 • Page 2 of 2 Resolution No. 9 3-113 WHEREAS, the City Council at said hearing further found that vacation and closure of said portion of public right-of-way is in conformity with the adopted General Plan, and WHEREAS, the City Council has considered the proposed Negative Declaration No. IS-1993-15 together with any comments received during the public review process, found on the basis of the Initial Study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment, approved the Negative Declaration and authorized the filing of a Notice of Determination, NOW, THEREFORE, BE IT RESOLVED as follows: 1. That the Mayor and City Clerk are respectively authorized and directed to execute and attest an Order to Vacate the above described portion of public right-of-way. 2. The City Clerk is hereby authorized and directed to cause a certified copy of subject order to be recorded in the office of the County Recorder of San Diego County, pursuant Section 8324, California Streets and Highways Code. EISER III CITY ATT ORNEY H a ORDER OF VACATION The City of National City, by authority of Resolution No. 93-113duly adopted on August 3, 1993, by the City Council of the City of National City, hereby orders the vacation of the following street within the City limits of National City: All that portion of the Southwesterly Quarter of Quarter Section 107, of the Rancho De La Nacion, in the City of National City, County of San Diego, State of California, according to Map thereof No. 166, made by Morrill on file in the Office of the Recorder of said San Diego County, described as follows: Commencing at the Northwesterly corner of said Southwesterly Quarter of said Quarter Section 107; thence South 19 00' East along the Westerly line of said Quarter Section a distance of 383.0 feet to the Southwesterly corner of a tract of land conveyed to the Rae Investment Company, by deed recorded in Book 865, Page 2 of Deeds, and the True Point of Beginning; thence continuing South 19 00' East along said Westerly line 98.0 feet; thence Northeasterly in a direct line to a point on the Southerly line of said land conveyed to the Rae Investment Company, distant thereon South 79 06' East, 200.61 feet from the Southwesterly corner thereof, thence Westerly along said southerly line 8.64 feet, more or less, to the Southwesterly line a F.A. Richard's Subdivision, according to Map thereof No. 2459; thence North 18 58'30" West along the Southwesterly line thereof 97.89 feet, more or less, to an intersection with a line which is parallel with and distant Southerly 218 feet from the Westerly prolongation of the North line of said F.A. Richard's Subdivision; thence South 70 51' West along said parallel line, a distance of 136.28 feet, more or less, to the Easterly line of land conveyed to the City of National City, by deed recorded in Book 4626, Page 261 of Official Records; thence South 18 56' 15" East along said Easterly line to the Southerly line of said land conveyed to Rae Investment Company; thence North 70 06' West along said Northerly line to the True Point of Beginning. Excepting therefrom the northerly 50 feet thereof. Also excepting therefrom the Westerly 30 feet thereof, as conveyed to the City of National City, and the Easterly 24' of the Westerly 54' dedicated for street purposes by Resolution of the City Council recorded May 26, 1992 as File/Page No. 1992-0317448 of Official Records.
