HomeMy WebLinkAboutCC RESO 93-126RESOLUTION NO. 93-126 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY ADOPTING AND IMPLEMENTING THE LAST, BEST OFFER OF THE CITY OF NATIONAL CITY TO THE NATIONAL CITY POLICE OFFICERS' ASSOCIATION, AMENDING THE PRELIMINARY BUDGET OF THE POLICE DEPARTMENT, RECALLING ALL POLICE OFFICERS WHO WERE LAID OFF, AND RESTORING THE RANK OF OFFICERS WHO WERE PREVIOUSLY DOWNGRADED WHEREAS, representatives of the City and of the National City Police Officers' Association (NCPOA) have met and conferred concerning a Memorandum of Understanding for FY 1993-1994; and WHEREAS, the City's representatives determined that negotiations were at an impasse after submitting the City's offer to the NCPOA on August 12, 1993; and WHEREAS, according to the National City Employer -Employee Relations Policy, the matter was considered by the Municipal Employees Relations Officer at an impasse meeting, and thereafter, the matter was submitted to the City Council for determination; and WHEREAS, on June 24, 1993, the City Council approved the preliminary budget of the Police Department for FY 1993-1994, which included a reduction in the number of police officers through layoffs and reductions in rank; and WHEREAS, it is the desire of the City Council to amend the preliminary budget of the police department for FY 1993-1994, and to recall the employees previously laid off and restore the rank of officers who were previously downgraded. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of National City that the City Council does hereby adopt and implement the last, best offer made by the City's representatives to the NCPOA until a memorandum of understanding is adopted. Said last, best offer is entitled "City Proposal, August 12, 1993," and is attached hereto as Exhibit "A" and incorporated herein by reference. Continued on Page Two Resolution No. 93-126 Page 2 of 2 BE IT FURTHER RESOLVED that the preliminary budget of the Police Department for FY 1993-1994 is hereby amended, said amended budget being attached hereto as Exhibit "B" and incorporated herein by reference. BE IT FURTHER RESOLVED that all police officers who were laid off from the Police Department are hereby recalled, and the rank of all officers who were downgraded is hereby restored. Eiser, III City Attorney EXHIBIT "A" CITY PROPOSAL AUGUST 12, 1993 1. Reduce base salary by five percent (5%) for all unit members and establish the attached furlough leave provisions for twelve full months. After twelve full months, the base salary for each unit position shall be restored to 1992-93 levels. 2. Suspend vacation sell -back for the 1993-94 fiscal year. 3. Suspend education pay, and holiday premium pay for hours worked for twelve full months. 4. Place Supervising Police Dispatcher and Dispatcher/Matron classifications in the general employee bargaining unit. DEFERRED HOURS ACCOUNT 1. Effective the first pay period that this agreement is in effect and each pay period thereafter during a twelve month period, each unit member shall accrue 8 hours of time in a deferred hours account that the employee is in a paid status. The total hours any employee can accrue in this account is 208 hours. 2. Personnel shall schedule at least 104 hours as time off during the 1994-95 fiscal year in the same manner as vacation. This time shall be scheduled before vacation time. These hours have no dollar value and cannot be cashed in, except as set forth in item #3 below. 3. Personnel who leave City employment prior to using the accrued time off referred to in 2 above shall be paid for such time on an hour for hour basis. 4. After two years of the effective date of this agreement, the City and POA will meet to determine the method of cashing out the remaining hours not to exceed 104 hours per employee. b12-93 NEGOPOAOOC AMENDMENT LANGUAGE TO VARIOUS ARTICLES ARTICLE 3 VACATION Section 5 - Vacation and holiday leave is credited as earned. An eligible employee may accumulate to a maximum of three (3) years of vacation and holiday leave, vacation and holiday leave accrual will be discontinued once the three (3) year maximum is reached. ARTICLE 6 PARENTAL CARE LEAVE Section 2 - (Subject to developing a family leave policy that complies with Federal law). A male employee may utilize parental leave without pay for purpose of assisting in the case of his newborn child. Consistent with the provisions of this MOU, sick leave up to a maximum of 80 hours and thereafter vacation may be utilized in conjunction with such leave. ARTICLE 12 OVERTIME (1) If an employee receives two (2) hours or less advance notice to report to work, compensation at the overtime rate shall start at the time of notification. ARTICLE 13 COMPENSATORY TIME OFF Section 1 - Consistent with Article 12 of this MOU, every employee is entitled to receive time and one half pay to be included in the pay period in which earned or at the discretion of the employee of having said hours logged as "comp time" with a maximum accumulation of 120 hours. Said hours of comp time shall be converted to the equivalent of straight time hours (Le., one hour of overtime equals one and one half hours comp. time). ARTICLE 17 EMPLOYEE LIFE INSURANCE As a benefit to full-time employees covered by this Memorandum of Understanding, the City will provide a group life insurance program of $10,000 for each employee. The benefits and limitations of the program are to be designed cooperatively by the Association, the insurance carrier and the City. &12A3 NEGOPOADOC ARTICLE 21 UNIFORM ALLOWANCE Section 1 The City shall provide the following amounts for each employee covered by this MOU to be applied towards the purchase and maintenance of prescribed uniforms: A. $450 per year: Police lieutenant, Police Officer Police Recruit, Police Sergeant and Senior Police Officer B. $300 per year: Animal Control Officer ARTICLE 25 - Work Week/Day be amended in pertinent part, to read: Section 4 - Except for operational needs caused by any circumstance which may require deployment modifications for manpower shortages because of unauthorized absences, or local or regional emergency, personnel schedule changes will be posted at least two (2) weeks in advance, except that proactive investigation units shall receive at least seventy-two (72) hours advance notice. Proactive units include those assigned to the Judge program, crime suppression, drunk driver enforcement, special investigations, narcotics, gang enforcement unit and problem response. They do not include care functions of units assigned to homicide, crimes of violence or crimes against property. (The term "unauthorized absences" used above includes resignation without a two (2) week notice.) In addition to the provisions contained in the above paragraph, the Chief retains the right to make immediate changes to facilitate an investigation or to address a situation that is of immediate concern to the City. Any personnel not given the appropriate notice provided for in this section shall receive for the first day of the shift change payment of overtime at the time and one half rate for hours worked.
