RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY
APPROVING A MEMORANDUM OF UNDERSTANDING
BY AND BETWEEN THE CITIES OF
NATIONAL CITY, LA MESA, CHULA VISTA, POWAY,
AND IMPERIAL BEACH FOR THE PURPOSES OF
ACQUIRING AND FUNDING CABLE TELEVISION RATE
REGULATION CONSULTING SERVICES WITH
REGARD TO COX CABLE SAN DIEGO, INC.
WHEREAS, the Cable Television Consumer Protection and Competition Act
of 1992 ("Cable Act") provides the opportunity for cities to regulate basic cable television
rates as prescribed in regulations designed by the Federal Communications Commission
("FCC"); and
WHEREAS, the Cities of National City, La Mesa, Chula Vista, Poway and
Imperial Beach ("the Cities") have been working together to develop an approach to
regulating cable television rates within their jurisdictions in an efficient and cost effective
manner; and
WHEREAS, the Cities have determined that working cooperatively on the
hiring of a consultant for the purpose of reviewing the financial and technical information
regarding cable television rates charged by Cox Cable San Diego, Inc. the cable television
service provider in the Cities, is the most efficient and effective means to perform the
duties of the rate regulation authority for the Cities; and
WHEREAS, the Cities have solicited requests for proposals for cable
television rate regulation consulting services, and received seven complete responses,
from which three firms were interviewed and one recommended for selection.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of National City that the Mayor is hereby authorized to execute a Memorandum of
Understanding with the Cities of La Mesa, Chula Vista, Poway and Imperial Beach to
retain the firm of Public Knowledge, Inc. for an amount not to exceed $6,200 to perform
certain cable rate regulation consulting services. Said Memorandum of Understanding
is on file in the Office of the City Clerk.
