HomeMy WebLinkAboutCC RESO 94-89RESOLUTION NO. 9 4- 89 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE MAYOR TO EXECUTE THE FIRST AMENDMENT TO THE MEMORANDUM OF UNDERSTANDING BY AND BETWEEN THE CITIES OF NATIONAL CITY, LA MESA, CHULA VISTA, POWAY, AND IMPERIAL BEACH FOR THE PURPOSES OF ACQUIRING AND FUNDING CABLE TELEVISION RATE REGULATION CONSULTING SERVICES WITH REGARD TO COX CABLE SAN DIEGO, INC. WHEREAS, the Cities of National City, Chula Vista, Imperial Beach, La Mesa and Poway (the "Cities") entered into the Original Agreement (the "Agreement") dated January 14, 1994 to hire the firm of Public Knowledge, Inc. (the "Consultant") to review the FCC Form 393's submitted to the individual Cities by Cox Cable San Diego, Inc. ("Cox Cable"); and WHEREAS, Section 4 of the Original Agreement indicates that, to the extent reasonably possible, said Original Agreement is intended to serve as a framework for future agreements between the Cities with respect to other cable related consulting services and issues, including, without limitation, further evaluations of the Cable Television Consumer Protection and Competition Act of 1992, applicable Federal Communications Commission ("FCC") rules and procedures, and other cable rate structure and increase issues; and WHEREAS, the Cities have determined that an amendment to the Original Agreement to obtain additional services from the Consultant is the most efficient and effective means to perform the additional rate regulation analysis resulting from the new FCC cable rate regulation guidelines effective May 15, 1994 and the FCC Forms 1200 and 1205 that Cox Cable will be submitting to the respective Cities. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of National City that the Mayor is authorized to execute an Amendment to the Original Agreement by and between the Cities of National City, Chula Vista, Imperial Beach, La Mesa and Poway to obtain additional services from Public Knowledge, Inc.
