HomeMy WebLinkAboutCC RESO 94-159• RESOLUTION NO. 94-159 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY INITIATING PROCEEDINGS AND ORDERING THE PREPARATION OF AN ENGINEER'S "REPORT" FOR CERTAIN ASSESSMENT DISTRICT PROCEEDINGS WHEREAS, the City Council of the City of National City at this time proposes to initiate proceedings for the formation of a special assessment district pursuant to the terms and provisions of the "Landscaping and Lighting Act of 1972," being Division 15, Part 2 of the Streets and Highways Code of the State of California (the "Landscaping and Lighting Act"), in what is known and designated as LANDSCAPE MAINTENANCE DISTRICT NO. 1 (MILE OF CARS) (hereinafter referred to as the "Assessment District"); and WHEREAS, the properties proposed to be included in the Assessment District are generally described as those properties fronting on National City Boulevard between 18th Street and 33rd Street or the southerly boundary of National City, as applicable; and WHEREAS, this legislative body is desirous to order the preparation of a "Report," as required by Section 22585 of the Streets and Highways Code of the State of California. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of National City as follows: RECITALS Section 1. That the above recitals are all true and correct. DESCRIPTION OF MAINTENANCE AND SERVICES Section 2. That the public interest and convenience requires, and this legislative body does propose at this time to initiate proceedings for the formation of a special Assessment district to provide for the following: The maintenance of median and sidewalk landscaping, sidewalks and street lighting facilities along National City Boulevard between l8th Street and 33rd Street and along 24th and 25th Streets between National City Boulevard and Transportation Avenue, and the payment of street lighting energy charges. Continued on Page Two Resolution No. 9 4-15 9 Page 2 of 2 DESCRIPTION OF ASSESSMENT DISTRICT Section 3. That said maintenance and street lighting will provide a special and direct benefit to the property and parcels of land within the boundaries of the Assessment District. The properties proposed to be included in the Assessment District are generally described as those properties fronting on National City Boulevard between 18th Street and 33rd Street or the southerly boundary of National City, as applicable. REPORT OF ENGINEER Section 4. That the proposed maintenance is hereby referred to NASLAND ENGINEERING, who is hereby directed to make and file the "Report" generally containing the following: A. Plans and specifications for the maintenance; B. An estimate of the costs of the maintenance and street lighting energy charges for the project and referenced fiscal year; C. A diagram for the Assessment District, showing the area and properties proposed to be assessed; D. An assessment of the estimated costs of the maintenance and street lighting energy charges, assessing the net amount upon all assessable lots and/or parcels within the Assessment District in proportion to the benefits received. That upon completion of the preparation of said "Report", the original shall be filed with the City Clerk, who shall then submit the same to this legislative body for its immediate review and consideration. FISCAL YEAR Section 5. That the above "Report" shall include all costs and expenses relating to the fiscal year commencing July 1, 1995, and ending June 30, 1996. Continued on Page Three , . .
