RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY
AUTHORIZING THE MAYOR TO EXECUTE A
SEWER AGREEMENT AND AN OUTDOOR MAINTENANCE AGREEMENT,
FOR THE PROPERTY AT THE SOUTHWEST CORNER OF
30TH STREET AND NORTH SECOND AVENUE
WHEREAS, Canyon-Cahan Properties ("Developer") wishes to develop
property at the southwest corner of 30th Street and North Second Avenue as a Food 4
Less Market; and
WHEREAS, the property is located in the City of Chula Vista, but there are
no sewer mains in Chula Vista that can feasibly provide sewer service to the property;
and
WHEREAS, the City of National City owns and operates a 6-inch sewer
main on 30th Street which can serve the property; and
WHEREAS, the City Council of the City of National City has determined
to permit Developer to use the National City sewer main on 30th Street to serve
Developer's property, subject to certain terms and conditions; and
WHEREAS, said terms and conditions have been memorialized in the
"Agreement Among the City of Chula Vista, the City of National City, and Canyon-
Cahan Properties for the Development of a Food 4 Less Market Within Chula Vista and
its Connection to the National City Sewer System," and in the "Outdoor Maintenance
Agreement between the City of National City and Canyon-Cahan Properties for the
Development of a Food 4 Less Market Within City Limits of Chula Vista."
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of National City that the Mayor is hereby authorized to execute an Agreement Among the
City of Chula Vista, the City of National City, and Canyon-Cahan Properties for the
Development of a Food 4 Less Market Within Chula Vista and its Connection to the
National City Sewer System and an Outdoor Maintenance Agreement between the City
of National City and Canyon-Cahan Properties for the Development of a Food 4 Less
Market Within City Limits of Chula Vista.

BE IT FURTHER RESOLVED that said Agreements shall be recorded in
the Office of the San Diego County Recorder.
PASSED and ADOPTED this 22nd day of November, 1994.
