HomeMy WebLinkAboutCC RESO 95-15RESOLUTION NO. 95-15 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY ORDERING WORK, FORMING ASSESSMENT DISTRICT AND CONFIRMING DIAGRAM AND ASSESSMENT WHEREAS, the City Council of the City of National City has initiated proceedings for the formation of a special assessment district pursuant to the terms and provisions of the "Landscaping and Lighting Act of 1972," being Division 15, Part 2 of the Streets and Highways Code of the State of California, said special assessment district known and designated as Landscape Maintenance District No. 1 (Mile of Cars) (hereinafter referred to as the "Assessment District"); and WHEREAS, at this time a public hearing has been held, and all persons have had an opportunity to speak, all in the manner and form as required by law, and this City Council is now satisfied with the assessment and diagram and all other matters as contained in the Engineer's "Report" as now submitted for final consideration and approval. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of National City as follows: RECITALS Section 1. That the above recitals are all true and correct. PUBLIC HEARING Section 2. That this legislative body does hereby declare as follows: A. That the public hearing is hereby closed. B. That all protests and objections of every kind and nature be, and the same hereby are, overruled and denied, and it is further determined that said protests and objections are made by the owners of less than one-half (1/2) of the area of property to be assessed for the maintenance of the improvements within said Assessment District. Continued on Page Two Resolution No. Page 2 of 3 FORMATION AND CONFIRMATION Section 3. That it is hereby further ordered and declared as follows: A. That the final Engineer's "Report," consisting of the final submitted assessment and diagram for the proceedings, is hereby approved and confirmed. B. That the public interest and convenience requires, and this legislative body does hereby formally order the maintenance to be done as set forth in the Engineer's "Report" and as previously declared and set forth in the Resolution of Intention. ASSESSMENTS Section 4. That it is hereby further declared and ordered that the assessments contained in said "Report" are hereby ordered to be levied and confirmed upon the respective subdivisions of land in the Assessment District in the amounts as set forth in said final "Report." Said assessments represent the annual levy of assessments for the maintenance of the improvements for the next fiscal year. RECORDATION OF ASSESSMENT Section 5. That the City Clerk shall forthwith deliver to the Superinten- dent of Streets the said assessment, together with the diagram attached thereto and made a part thereof, as confirmed, with his certificate of such confirmation attached and the date thereof; and that said Superintendent shall then immediately record said diagram and assessment in his Office in a suitable book to be kept for that purpose and attach thereto his certificate of the date of such recording. COUNTY RECORDER NOTICE Section 6. Upon confirmation of the assessments and recordation of the assessment roll and diagram, a certified copy of the Assessment Diagram shall be immediately filed in the Office of the County Recorder. Immediately thereafter, a copy of the Notice of Assessment shall be recorded in the Office of the County Recorder in the manner and form as set forth by law and specifically Section 3114 of the Streets and Highways Code of the State of California. Continued on Page Three Resolution No. Page 3 of 3 COUNTY AUDITOR Section 7. Immediately after the adoption of this Resolution, a certified copy of the assessment roll and diagram shall be filed with the County Auditor. ASSESSMENT COLLECTION Section 8. The County Auditor shall enter on the County assessment roll opposite each lot or parcel of land in the Assessment District the amount assessed thereon, as shown in the transmitted assessment roll and diagram. The assessments shall be collected at the same time and in the same manner as County taxes are collected,and all laws providing for the collection and enforcement of County taxes shall apply to the collection and enforcement of the assessments. After collection by the County, the net amount of the assessments, after deducting compensation due the County for collection, shall be paid to the Treasurer.
