HomeMy WebLinkAboutCC RESO 95-50RESOLUTION NO. 95-50 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY SUPPORTING AB 135 TO EXTEND THE ABANDONED VEHICLE ABATEMENT PROGRAM WHEREAS, Section 22710 of the California Vehicle Code provides for the establishment of a Service Authority for abandoned vehicle abatement and imposition of a $1.00 vehicle registration fee; and WHEREAS, Section 9250.7 of the Vehicle Code, Subsection (c) states that the fee imposed by a service authority shall remain in effect only for a period of five years from the date that actual collection of the fee commenced, and Section 22710 (f) states that a service authority shall cease to exist on the date that all revenues received by the authority pursuant to this section and Section 9250.7 have been expended: and WHEREAS, the San Diego Abandoned Vehicle Abatement Service Authority was formed in October 1991, and the collection of fees began May 1, 1992 and is scheduled to end April 30, 1997; and, WHEREAS, Assembly Member Rainey has introduced Assembly Bill 135 that would amend Section 9250.7 to eliminate Subsection (c), the five-year collection fee time frame; and would amend Section 22710 (f) to eliminate the cessation of the authority; and WHEREAS, the City Council of the City of National City has found that an organized program for the abatement of vehicles is needed to protect the health and safety of citizens; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of National City that the City Council supports the passage of that portion of AB 135 which removes the five-year limit for collection of fees and which eliminates cessation of the authority; the City Council takes no position regarding any other portions of AB 135.
