RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY
DECLARING THE EXISTENCE OF AN EMERGENCY AND AUTHORIZING
THE CITY MANAGER TO EXECUTE A CONTRACT WITHOUT
COMPLYING WITH COMPETITIVE BIDDING PROCEDURES
FOR REINSTALLATION OF A SEWER LINE AT
30TH STREET AND NATIONAL CITY BOULEVARD
WHEREAS, it has come to the attention of the City Council that an
emergency situation has arisen by virtue of a leaking sewer line serving private properties
in the vicinity of 30th Street and National City Boulevard, which has resulted in the
discharge of raw sewage into private property and public right-of-way on several
occasions; and
WHEREAS, the Director of Public Works has recommended that the
emergency situation can best be corrected by the reinstallation of a sewer line in the 30th
Street right-of-way by a private contractor; and
WHEREAS, the Director of Public Works has further recommended that
the public interest and necessity demand the immediate expenditure of public money for
the reinstallation of said sewer line in order to safeguard life, health and property; and
WHEREAS, said emergency situation will not permit a delay resulting from
a competitive solicitation for bids, and immediate action in reinstallation of the sewer line
is necessary to respond to the emergency; and
WHEREAS, pursuant to Section 20168 of the Public Contract Code, the
City Council, pursuant to a resolution adopted by a four -fifths vote of the City Council,
may declare that the public interest and necessity demand the immediate expenditure of
public money to safeguard life, health, property and expend money on a public project
without complying with the competitive bidding procedures; and
WHEREAS, pursuant to Section 22050 of the Public Contract Code, the
City Council may, in the case of an emergency, repair or replace a public facility, take
any directly related and immediate action required by that emergency, and procure the
necessary equipment, services, and supplies for those purposes, without giving notice for
bids to let contracts.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of National City as follows:

1. That the City Council finds that due to the existence of the emergency
situation described hereinabove, the public interest and necessity demand the immediate
expenditure of public money for the reinstallation of a sewer line in 30th Street near
National City Boulevard in order to safeguard life, health and property.
2. That the City Council finds that said emergency situation will not
permit a delay resulting from a competitive solicitation for bids, and that immediate
action in reinstallation of the sewer line is necessary to respond to the emergency.
BE IT FURTHER RESOLVED that the City Manager is hereby authorized
to execute a contract with a private contractor for the reinstallation of the sewer line at
30th Street and National City Boulevard, without complying with competitive bidding
procedures.
