HomeMy WebLinkAboutCC RESO 95-168RESOLUTION NO. 9 5 —16 8 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, DENYING AN APPLICATION FOR VACATION OF THE PORTION OF 27TH STREET BETWEEN NATIONAL CITY BOULEVARD AND 'A' AVENUE. APPLICANT: GEORGE WEBSTER CASE FILE NO.: SC-1995-2 WHEREAS, a Street Vacation application for vacation of the portion of 27th Street between National City Boulevard and 'A' Avenue was considered by the City Council of the City of National City at a public hearing held on November 14, 1995, at which time oral and documentary evidence was presented; and, WHEREAS, at said public hearing the City Council considered the staff report contained in Case File No. SC-1995-2, which is maintained by the City, and incorporated herein by reference; and, WHEREAS, this action is taken pursuant to all applicable procedures required by State and City law; and, WHEREAS, the action recited herein is found to be essential for the preservation of public health, safety and general welfare. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of National City, California, that the testimony and evidence presented to the City Council at the public hearing held on November 14, 1995, fail to support findings pursuant to Sections 8313 and 8324 of the Streets and Highways Code of California and Section 65402 of the Government Code, that the subject portion of right-of-way is consistent with the City's General Plan, and that the subject portion of right-of-way is needed for present or prospective public use. BE IT FURTHER RESOLVED, by the City Council of the City of National City, California, that the testimony and evidence presented to the City Council at the public hearing held on November 14, 1995, support the following findings: 1. That the vacation of subject portion of right-of-way is not consistent with the City's General Plan, since the General Plan has policies which encourage convenient access to residential neighborhoods and 27th Street provides access between the residential neighborhood and National City Boulevard. 2. That this portion of right-of-way is needed for present or prospective public use, since 27th Street between National City Boulevard and 'A' Avenue provides convenient access to and from the residential neighborhood to the east. CONTINUED ON PAGE 2 Resolution No. 9 5-1 6 8 Page 2 of 2 BE IT FURTHER RESOLVED that the City Council hereby denies Street Vacation SC-1995-2. BE IT FURTHER RESOLVED that this Resolution shall become effective and final on the day following the City Council meeting where the resolution is adopted. The time within which judicial review of this decision may be sought is governed by the Code of Civil Procedure Section 1094.6. PASSED AND ADOPTED this 21st day of November, 1995. GEORGE H.
