HomeMy WebLinkAboutCC RESO 96-30RESOLUTION NO. 96-30 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY OPPOSING ASSEMBLY BILL 638 AND SUPPORTING THE CURRENT SAN DIEGO COUNTY SYSTEM FOR ISSUING CONCEALED WEAPONS PERMITS WHEREAS, AB 638, if enacted into law, will mandate police chiefsand sheriffs to issue concealed firearm permits to anyone who applies except those with prior felony records, those who are committed to mental hospitals, or those who have gone through a domestic violence diversion program within the last ten years; and WHEREAS, AB 638 is actively opposed by California law enforcement organizations representing both labor (Peace Officers Research Association of California) and management (California Police Officers Association, California Police Chiefs Association and California Sheriffs Association); and WHEREAS, under current law, sheriffs and chiefs of police may issue a permit for a citizen to carry a concealed weapon when they determine that the applicant is of good character and has shown good cause to carry a concealed weapon in public; and WHEREAS, in San Diego County, chiefs of police and the sheriff have, for over twenty years, agreed to a system whereby the San Diego County Sheriff is the sole source for issuance of concealed weapons permits within the county; and WHEREAS, the current San Diego County system for issuing concealed weapons permits has worked well for the following reasons: • It provides a common standard for all citizens of San Diego County. • It prevents "permit shopping" by individuals who, under law, can be issued a permit by any police chief in the county regardless of the residence of the citizen. • It removes the politics from the process and assures a decision based on objective criteria which treats all citizens the same. • It provides a single repository of information relating to issued concealed weapons permits. • It allows for local control through a single elected official, elected by the citizens of San Diego County; and Continued on Page Two Resolution No. 96-30 Page 2 of 2 WHEREAS, the current San Diego County system for issuing concealed weapons permits is endorsed by the San Diego County Police Chiefs' and Sheriff's Association; and WHEREAS, the system proposed pursuant to AB 638 will increase costs to cities in issuing concealed weapons permits, will result in an increase in confrontation and litigation among members of an armed populace, and will jeopardize the safety of the residents of the state. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of National City that the City Council does hereby oppose AB 638, and does hereby support the current San Diego County system for issuing concealed weapons permits. BE IT FURTHER RESOLVED that the City Clerk is directed to forward this resolution to Senator Peace and Assemblywoman Ducheny at the earliest date possible after its adoption, and to distribute copies of the Board of Supervisors and the other cities within the County.
