HomeMy WebLinkAboutCC RESO 96-37RESOLUTION NO, 96 - 3 7 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY OPPOSING ASSEMBLY BILL AB 2569 WHEREAS, AB 2569 would prohibit the use of eminent domain for acquisition of land used for a privately -owned business for eventual use by another privately -owned business; and WHEREAS, the Community Development Commission of the City of National City, the community's housing authority and redevelopment agency, has used its eminent domain authority in the past to acquire properties used for privately -owned businesses which constituted a severe blight in the community, and such properties have since been devoted to use by other privately -owned businesses which now benefit the community; and WHEREAS, pursuant to its current redevelopment plan, the CDC plans to utilize its eminent domain authority for such acquisitions in the future; and WHEREAS, passage of AB 2569 would impede the efforts of the Community Development Commission of the City of National City to eliminate blight, and would be contrary to the best interests of the community; and WHEREAS, the League of California Cities and the California Redevelopment Association oppose AB 2569 for the following reasons: 1. The use of eminent domain should be a local decision based on local circumstances. 2. This bill would make downtown redevelopment prohibitively expensive, or impossible to implement. 3. Existing law already provides business owners with adequate protection and full compensation. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of National City that the City Council does hereby oppose AB 2569. BE IT FURTHER RESOLVED that the City Clerk is directed to forward this resolution to Senator Peace and Assemblywoman Ducheny at the earliest date possible after its adoption, and to distribute copies to the Board of Supervisors and the other cities within the County.
