A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY, CALIFORNIA,
APPROVING A TENTATIVE SUBDIVISION MAP TO
DIVIDE ONE PARCEL INTO FIVE AT THE NORTHEAST
CORNER OF 16TH STREET AND HARBISON AVENUE.
APPLICANT: CHRISTMAS IN APRIL-NATIONAL CITY
CASE FILE NO. S-1995-1
WHEREAS, application was made for approval of a tentative subdivision map for the division
of one parcel into five at the northeast corner of 16th Street and Harbison Avenue on property
generally described as:
The southerly 200 feet of the easterly 220 feet (except streets) of Quarter Section 106,
Rancho De La Nacion, according to Map thereof made by Morrill, No. 166, in the
Office of the Recorder of said San Diego County, excepting therefrom that portion as
granted to the City of National City, recorded November 24, 1954 in Book 5439, Page
493.
WHEREAS, the Planning Commission of the City of National City, California, considered
said application and proposed Negative Declaration No. IS-1995-15 at a public hearing held on
February 5, 1996, at which time the Planning Commission considered oral and documentary
evidence, and the staff report contained in Case File Nos. S-1995-1 and IS-1995-15, which are
maintained by the City and incorporated herein by reference; and,
WHEREAS, the City Council of the City of National City considered said application and
proposed Negative Declaration No. IS-1995-15 at the public hearing held on April 9, 1996, at which
time the City Council considered oral and documentary evidence, as well as the record of the
proceedings before the Planning Commission, and the staff report contained in Case File No. S-1995-
1, which are incorporated herein by reference; and,
WHEREAS, this action is taken pursuant to all applicable procedures required by State law
and City ordinances; and,
WHEREAS, the action recited herein is found to be essential for the preservation of public
health, safety and general welfare.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of National City
has considered the proposed Negative Declaration together with any comments received during the
public review process and all evidence and testimony presented at the hearing and finds that on the
basis of the Initial Study and any comments received that there is no substantial evidence that the
project will have a significant effect on the environment, approves the proposed Negative Declaration,
and authorizes the filing of a Notice of Determination.

BE IT FURTHER RESOLVED by the City Council of the City of National City that it hereby
approves the tentative subdivision map to divide one parcel into five parcels, based on the following
findings:
1. The tentative map is consistent with the National City General Plan and applicable
specific plans, since the Combined General Plan/Zoning Map designation for the property
is CL-PD-H35 (Limited Commercial -Planned Development-35 foot height limit) which
requires a minimum lot size of 5,000 sq.ft. of which each of the proposed lots exceed.
Proposed development of a single-family home on each of the newly created parcels is a
permitted use in the underlying zone designation which applies to the property. There
are no specific plans which apply to the property.
2. The site is physically suitable for the proposed type of development, since there is
adequate area for single -story residential development in accordance with all Land Use
Code requirements.
3. The site is physically suitable for the proposed density of development, since adequate
area is provided on each of the newly created parcels for development of a single-family
home in accordance with all Land Use Code requirements.
4. The design of the subdivision or the proposed improvements are not likely to cause
substantial environmental damage or substantially and avoidably injure fish or wildlife or
their habitat, since the site is disturbed and does not provide fish or wildlife habitat.
5. The design of the subdivision or the type of improvements are not likely to cause serious
public health problems, since all necessary public services will be provided.
6. The design of the subdivision or the type of improvements will not conflict with
easements, acquired by the public at large, for access through or use of the property
within the proposed subdivision, since no such easements are located on the site.
7. The discharge of sewerage waste from the subdivision into the City of National City
sewer system will not result in violation of existing requirements prescribed by the
California Regional Quality Control Board pursuant to Division 7 (commencing with
Section 13000) of the Water Code, as specified by Government Code Section 66474.6.
8. The subdivision has been considered by the Planning Commission with regard to its
effect on the housing needs of the region, and these needs are balanced by the public
service needs of the residents and available fiscal and environmental resources.

9. The design of the subdivision provides, to the extent feasible, for future passive and
natural heating and cooling opportunities in the subdivision, based on consideration of
local climate, contour, property configuration and other design and improvement
requirements without requiring reduction in allowable density or lot coverage.
BE IT FURTHER RESOLVED that based on the findings hereinbefore stated, said tentative
subdivision map for division of one parcel into five is hereby approved subject to the following
conditions:
1. A grading and drainage plan shall be submitted showing all proposed and existing on -site
and off -site improvements. The plan shall be prepared in accordance with the City's
standard requirements by a registered civil engineer.
2. A drainage study shall be submitted in conjunction with plans for development of the
property.
3. All surface runoff, including landscaping, shall be collected by approved drainage
facilities and directed to the street by sidewalk underdrains or a curb outlet. Adjacent
properties shall be protected from surface runoff as a result of this development.
4. A soils engineering report shall be submitted for the Engineering Department's review.
The report shall address the stability of all existing and proposed slopes on the property.
It shall also address the adequacy of building pads, the criteria for any new retaining wall
design, the maximum allowable soil bearing pressure and the required structural section
for the proposed on -site pavement areas.
5. A sewer permit will be required. The method of sewage collection and disposal shall be
shown on the grading plan.
6. Property dedication will be required for additional street right-of-way in the southwest
corner of the property at the 16th Street/Harbison Avenue intersection in order to
accommodate a new 30 foot radius curb return and associated improvements.
7. The deteriorated portions of the sidewalk on Harbison Avenue and the raised sidewalk
adjacent to the curb return shall be removed and replaced.

8. A new pedestrian ramp shall be constructed at the corner of 16th Street and Harbison
Avenue per San Diego Regional Standard Drawing G-27.
9. A new street light is required on 16th Street. The street light shall be per City standards.
Its location shall meet A.D.A. clearance requirements.
10. The unused driveways shall be removed and replaced with full height curb and sidewalk.
Also, the existing driveway openings near the curb return shall also be abandoned. All
driveways (new and existing) shall be shown on the plan.
11. A permit shall be obtained from the Engineering Department for all improvement work
within the public right-of-way and all grading work on private property.
12. A cost estimate shall be submitted with the plans for all proposed grading, drainage,
street improvement, landscaping and retaining wall work. Three percent (3 %) of the
estimated cost shall also be deposited with the City as an initial cost for plan checking and
inspection services at the time the grading permit and/or fmal map are submitted. The
deposit is subject to adjustment.
13. A title report shall be submitted to the Engineering Department with the fmal map.
14. The curb return at the northeast corner of 16th Street and Harbison Avenue shall be
widened to a 30 foot radius return, complete with a new pedestrian ramp and sidewalk.
A separate street improvement plan will be required for the widening.
15. The final map shall meet all requirements of the Subdivision Map Act and the National
City Municipal Codes, including certification, acknowledgment, complete boundary
information and monumentation.
16. The subdivider shall submit an approval letter from Sweetwater Authority stating all fire
flow requirements have been met. If additional improvements are needed, the developer
shall enter into an agreement for necessary water facility improvements with the
Authority prior to obtaining fmal map approval.
17. Separate water and sewer laterals shall be provided for each lot.
18. The developer shall bond for the monumentation and public improvements and on -site
grading, drainage, landscaping and other improvements through an agreement with the
City prior to fmal map approval.

19. All new utility distribution facilities within the boundaries of the subdivision and within
the half street abutting the subdivision shall be placed underground.
20. The fmal map shall be recorded prior to issuance of any building permit.
21. The subdivider shall coordinate with the National City Transit Company for the
relocation of the bus zone and the sign on 16th Street, if such relocation is necessary.
Otherwise, the bus zone shall be upgraded to Metropolitan Transit Development Board
standards, including the provision of red -curbing. The grading plan shall show the bus
zone and related improvements.
22. The developer shall verify with the Engineering Department that no underground fuel
tanks remain at the site from the former gas station and that any underground
contamination has been corrected and eliminated prior to fmal map approval.
23. New red zones for "No Parking" along the property frontages may be required for site
visibility purposes upon review of a more complete drawing showing proposed driveways
for the newly created lots.
24. School impact fees shall be paid at the time of building permit issuance.
25. The final map shall be in substantial conformance with the tentative map as depicted in
Exhibit A, case file no. S-1995-1, dated 11/27/95.
26. Each parcel shall have a minimum of 50 feet of street frontage and be a minimum of
5,000 sq.ft. in area.
27. The approval of the tentative map expires 2 years after adoption of the resolution of
approval at 5:00 p.m. unless prior to that date a request for time extension not exceeding
an additional three years has been filed as provided by Section 66452.6(e) of the
California Government Code.
BE IT FURTHER RESOLVED that copies of this Resolution be transmitted forthwith to the
applicant and City Council.
BE IT FURTHER RESOLVED that this action will become final and effective on the date of
its adoption. The time within which judicial review of this decision may be sought is governed by the
provisions of Code of Civil Procedure Section 1094.6.
