HomeMy WebLinkAboutCC RESO 96-55RESOLUTION NO. 96-55 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY DECLARING G. S. VALLEY GRADING, INC. TO BE THE LOWEST RESPONSIVE BIDDER AND AUTHORIZING THE MAYOR TO EXECUTE AN AGREEMENT WITH G. S. VALLEY GRADING, INC. FOR THE SEWER REPAIR PROJECT FY 1995-96, AND APPROVING A SUBSTITUTION OF SUBCONTRACTORS FOR SAID PROJECT (Engineering Spec. No. 96-3) WHEREAS, the Engineering Department of the City of National City did in open session, on April 3, 1996, publicly open, examine and declare all sealed bids for the Sewer Repair Project FY 1995-96; and WHEREAS, G. S. VALLEY GRADING, INC., submitted the lowest responsive bid for said project; and WHEREAS, G. S. VALLEY GRADING, INC. has within two working days of the bid opening, given written notice to the City that a subcontractor was listed in error in its bid, and has provided copies of that notice both to SANCON ENGINEER- ING, the subcontractor claimed to have been listed in error, and to JESS B. WORTH- INGTON, the intended subcontractor who had bid prior to bid opening; and WHEREAS, G. S. VALLEY GRADING, INC. has requested that the City approve a substitution of the manhole installation and rehabilitation contractor for the project from SANCON ENGINEERING, INC., the listed subcontractor, to JESS B. WORTHINGTON, the intended subcontractor, on the basis of inadvertent clerical error; and WHEREAS, G. S. VALLEY GRADING, INC. and JESS B. WORTHING- TON have submitted affidavits to the City in support of the claim that an inadvertent clerical error was made; and WHEREAS, SANCON ENGINEERING, INC. has not submitted an affidavit to the City within six working days objecting to the claim of inadvertent clerical error; and Continued on Page Two Resolution No. 96-55 Page 2 of 2 WHEREAS, pursuant to Sections 4107 and 4107.5 of the California Public Contract Code, the City Council held a public hearing on May 7, 1996, on or about 3:00 p.m, in the City Council Chambers, 1243 National City Boulevard, National City, at which time it considered oral and documentary evidence concerning the requested substitution of contractors; and WHEREAS, after said public hearing the City Council found and determined that there were no compelling reasons to deny the substitution of contractors, and further found and determined that there was a sufficient basis to approve the substitution of contractors based on inadvertent clerical error. NOW, THEREFORE, IT IS HEREBY RESOLVED, that the City Council of the City of National City hereby awards the contract for the Sewer Repair Project FY 1995-96 to the lowest responsive bidder, to wit: G. S. VALLEY GRADING, INC. BE IT FURTHER RESOLVED that the City Council hereby finds and determines that there are no compelling reasons to deny the request for substitution of contractors of G. S. VALLEY GRADING, INC., and that there is sufficient basis to approve the substitution of contractors based on inadvertent clerical error, and the City Council does hereby approve the substitution of JESS B. WORTHINGTON for SANCON ENGINEERING, INC. pursuant to Sections 4107 and 4107.5 of the California Public Contract Code. BE IT FURTHER RESOLVED by the City Council that the Mayor is hereby authorized to execute on behalf of the City, a contract between G. S. VALLEY GRADING, INC. and the City of National City to provide for the Sewer Repair Project FY 1995-96 in accordance with the Engineering Department Plans and Specifications.
