HomeMy WebLinkAboutCC RESO 96-134RESOLUTION NO. 96-134 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY APPROVING AN EXCEPTION TO THE STANDARDS FOR PUBLIC RIGHTS -OF -WAY AND IMPROVEMENTS IN CONNECTION WITH THE DEVELOPMENT OF PROPERTY ON THELMA WAY, SUBJECT TO CERTAIN CONDITIONS WHEREAS, Miguel Cuevas (the Owner) is required to construct a permanent cul-de-sac in conjunction with the development of two lots (A.P.N. 669-040- 08 and 669-040-23) on Thelma Way; and WHEREAS, due to inadequate right-of-way, physical site limitations and terrain problems, the Owner is purposing to construct a 19-foot radius cul-de-sac; and WHEREAS, City Standards for Public Rights -of -Way and Improvements, adopted pursuant to Ordinance No. 92-2033, require a minimum 38-foot radius cul-de- sac; and WHEREAS, the Fire Department's Standards require a minimum 90-foot diameter cul-de-sac; and WHEREAS, the Engineering and Fire Departments have reviewed the Owner's street improvement plan, and are prepared to recommend an exception to their respective Standards, provided that the Owner complies with certain conditions; and WHEREAS, the City's Standards provide for the granting of exceptions, where flexibility is needed in order to meet existing conditions. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of National City that the improvement plans of Miguel Cuevas for the construction of a 19-foot radius cul-de-sac in conjunction with the development of two lots (A.P.N. 669-040-08 and 669-040-23) on Thelma Way is hereby approved, subject to the following conditions: 1. Theentry into the cul-de-sac shall be at least 20-feet wide. 2. Both houses to be constructed on the lots shall be equipped with fire sprinklers in accordance with national safety regulations.
