HomeMy WebLinkAboutCC RESO 98-36RESOLUTION NO. 98 — 36 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY APPROVING THE SALE OF REAL PROPERTY AT NOT LESS THAN FAIR REUSE VALUE TO EFFECTUATE THE PURPOSES OF THE NATIONAL CITY REDEVELOPMENT PROJECT WHEREAS, Gildardo Turullols, M.D., Inc., (hereinafter referred to as "Developer") is acquiring the real property located at 1428 Highland Avenue (hereinafter referred to as "Property"); and WHEREAS, said real property is located within the National City Redevelopment Project, established by the City Council; and WHEREAS, the Community Development Commission of the City of National City ("CDC") desires to benefit the Project Area by assisting the Developer in the establishment of a medical office, laboratory and pharmacy; and WHEREAS, the Developer has represented to the CDC that they have the experience and qualifications to successfully establish and operate such medical facility; WHEREAS, the CDC is authorized, pursuant to Section 33339-33340 of the California Health and Safety Code, to participate with property owners within the Project Area to redevelop their properties; and WHEREAS, the Developer has requested the financial assistance of the CDC in establishing the proposed medical facility within the Project Area, and the CDC is willing to grant the requested assistance upon the terms and conditions set forth in the document entitled "Disposition and Development Agreement", which is on file in the office of the Executive Director of the CDC; and WHEREAS, the CDC is authorized pursuant to Section 33433 of the California Health and Safety Code, to sell real property acquired with tax increment moneys at not less than the fair reuse value if, after a public hearing, the City Council by majority vote approves the sale pursuant to a resolution containing certain fmdings; and WHEREAS, the City Council of the City of National City provided a public notice and held a public hearing on April 7, 1998, to consider the sale of the property at not less than reuse value. Resolution No. 98 - 36 April 7, 1998 Page Two NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of National City that the City Council does hereby find as follows: 1. That the sale of the real property at 1428 Highland Avenue, National City, to Gildardo Turullols, M.D., Inc., at not less than fair reuse value is necessary to effectuate the purposes of the National City Redevelopment Project. 2. That said sale will further the objectives of the National City Redevelopment Project by providing employment opportunities, maintaining a sound economic base, and by bringing additional sales tax revenue to the City of National City. 3. That said sale will further the objectives of the National City Redevelopment Project by causing an increase in tax increment for the affected real property in the amount of approximately $7,000 per year. 4. That said sale will further the objectives of the National City Redevelopment Project by ensuring that the new medical facility will locate and remain in National City rather than in another location. 5. That said sale will assist in the elimination of blight. 6. That said sale is consistent with the implementation plan adopted pursuant to Health and Safety Code Section 33490. 7. That the consideration from said sale is not less than the fair reuse value at the use and with the convenants and conditions and development costs authorized by the sale. BE IT FURTHER RESOLVED that based on the above findings, the sale of the real property at 1428 Highland Avenue to Gildardo Turullols, M.D., Inc. at not less than the fair reuse value is hereby approved.
