D. a, CMC City Clerk of the City of National City No+ AdopFei RESOLUTION NO. 2002 — 48 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING A MILLS ACT PROGRAM FOR HISTORIC PROPERTIES WHEREAS, the General Plan of the City of National City states that the City will encourage and assist efforts for the preservation, maintenance and restoration of historically significant buildings and sites; and WHEREAS, California Government Code Section 50280 et seq. and California Revenue and Taxation Code Section 439.2 et seq. of the provide authority for the City to enter into a Mills Act contract with the property owner(s) of a "Qualified Historic Property" as defined by Government Code Section 50280.1 to provide a property tax reduction in exchange for the preservation and restoration of said Historic Property; and WHEREAS, the City maintains an adopted "List of Identified Historic Sites in National City" as approved by the City Council. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of National City, California, hereby authorizes the implementation of a Mills Act program pursuant to State law in accordance with the following: 1. Mills Act contracts shall be permitted only: for sites on the "List of Identified Historic Sites in National City", and shall incorporate all the requirements for administration, cancellation, and renewal prescribed by California Government Code Sections 50280 et seq. and California Revenue and Taxation Code Section 439.2 et seq. 2. Applications for Mills Act contracts shall be made to the Planning Department on a form prescribed by the Planning Director, and shall include documentation demonstrating the need for a Mills Act contract for the property, photos of the structure, and a maintenance/restoration plan along and other information deemed necessary by the Planning Director. 3. Applications for Mills Contracts must be submitted by August 31 to affect the next assessment period. 4. Applications shall be routed to the National City Historic Society and Community Development Commission staff for comment. 5. The City Council shall have approval authority for each contract. 6. Community Development Commission staff shall conduct yearly inspections to verify properties are being maintained and/or restored in compliance with the contract. -- Signature Page to Follow -- Resolution No. 2002 - 48 April 2, 2002 Page Two PASSED and ADOPTED this 2 ' day of April, 2002.
