CASE FILE NO. CDP-2003-2/IS-2003-1 WHEREAS, the City Council of the City of National City considered an appeal of the Planning Commission's denial of a Coastal Development Permit for a ready mixed concrete production and distribution facility on the south side of the 900 block of Bay Marina Drive at a duly advertised public hearing held on August 5, 2003, and continued to the meeting of September 16, 2003, at which time oral and documentary evidence was presented; and WHEREAS, at said public hearing the City Council considered the staff report contained in Case File Nos. CDP-2003-2/IS-2003-1, which is maintained by the City and incorporated herein by reference; and WHEREAS, this action is taken pursuant to all applicable procedures required by State and City law; and WHEREAS, the action recited herein is found to be essential for the preservation of public health, safety and general welfare. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of National City that the testimony and evidence presented to the City Council at the public hearing held on August 5, 2003, and continued to the meeting of September 16, 2003, failed to support the findings required by the National City Local Coastal Program for granting any Coastal Development Permit and that the proposed development is consistent with all other City plans and ordinances, in addition to the Local Coastal Program. BE IT FURTHER RESOLVED by the City Council of the City of National City that the testimony and evidence presented to the Planning Commission at the public hearing held on August 5, 2003, and continued to the meeting of September 16, 2003, supports the following finding: That granting of this Coastal Development Permit is not consistent with all City plans and ordinances, since General Plan policies encouraging new development to be appropriate to the needs of the community and to enhance surrounding areas, such as the nearby Tourist Commercial - zoned properties, will not be achieved by development of the concrete production and distribution facility at the proposed site.
