HomeMy WebLinkAboutCC RESO 2004 - 158RESOLUTION NO. 2004 — 158 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY CONSENTING TO AND CALLING FOR A JOINT PUBLIC HEARING OF THE CITY COUNCIL AND COMMUNITY DEVELOPMENT COMMISSION ON THE PROPOSED 2004 AMENDMENT TO THE REDEVELOPMENT PLAN FOR THE NATIONAL CITY REDEVELOPMENT PROJECT TO EXTEND THE AUTHORITY TO USE EMINENT DOMAIN WHEREAS, the City Council of the City of National City did duly pass and adopt a Redevelopment Plan for the National City Redevelopment Project; and WHEREAS, the Community Development Commission of the City of National City has formulated an Amendment to the Redevelopment Plan for the National City Redevelopment Project to expand the eminent domain authority over vacant land and buildings (as defined in the National City Municipal Code Section 7.06.020), and commercial and industrial zoned properties within the entire National City Redevelopment Project Area; and WHEREAS, the current exemption preventing the acquisition of single family residences by eminent domain will not be changed as part of the proposed Amendment to the Redevelopment Plan for the National City Redevelopment Project; and WHEREAS, pursuant to Sections 33458 and 33355 of the California Community Redevelopment Law, Health and Safety Code Sections 33000 et seq., a joint public hearing on the 2004 Amendment to the Redevelopment Plan for the National City Redevelopment Project may be held with the consent of the City Council and Community Development Commission. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of National City hereby consents and calls for a Joint Public Hearing with the Community Development Commission on September 21, 2004, at 6:00 p.m. for the purpose of considering the proposed 2004 Amendment to the Redevelopment Plan for the National City Redevelopment Project, and directs Staff to give notice of the Joint Public Hearing in the form and manner required by the California Community Redevelopment Law.
