RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY
AUTHORIZING THE CITY MANAGER TO WAIVE
THE PROVISIONS OF CHAPTER 2.60 OF THE MUNICIPAL CODE
WHEN NECESSARY AND APPROPRIATE FOR PROCUREMENT
OF PUBLIC SAFETY EQUIPMENT, TRAINING AND SERVICES
RELATED TO HOMELAND SECURITY
WHEREAS, the U.S. Department of Homeland- Security is making grant
funds available to reimburse public agencies and cities for public safety equipment,
training and services; and
WHEREAS, the procedures for eligibility for reimbursement often require
the expenditure of funds within a tightly compressed schedule. which may, on occasion,
make compliance with normal purchasing guidelines and training submission
procedures impracticable or impossible due to those compressed timelines; and
WHEREAS, the City needs to be able to take advantage of federal and
State reimbursement funding to accomplish vital and necessary Homeland Security
objectives in a fiscally prudent manner.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
National City as follows:
1. The City Manager is hereby authorized to waive, as necessary and appropriate,
on a case by case basis, the .provisions of Chapter 2.60 of the Municipal Code
for the ptirchase of public safety related equipment on a cost reimbursement
basis.
2. The City Manager is authorized to establish, through the Finance Department, a
cost reimbursable account for procurement and reimbursement of qualifying
public safety related equipment, training and services, and to make the
necessary applications therefor.
3. The City Manger shall make quarterly reports for the City Council regarding
acquisitions and training accomplished, and services provided through this
waiver.
4. The City Manager shall otherwise observe the normal requirements for
procurement, training and services when conditions for waiver do not exist.
5. This authorization shall expire on June 30, 2006, unless extended or modified
prior to that date.
