HomeMy WebLinkAboutCC RESO 2005 - 115RESOLUTION 2005 —115 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY APPROVING A LOCAL COASTAL PROGRAM AMENDMENT, AND APPROVING AN AMENDMENT TO THE COMBINED GENERAL PLAN/ZONING MAP FROM MM (MEDIUM MANUFACTURING ZONE) AND CZ (COASTAL ZONE) TO CT (TOURIST COMMERCIAL ZONE), PD (PLANNED DEVELOPMENT ZONE), AND CZ (COASTAL ZONE) FOR THE MARINA GATEWAY PLACE PROJECT APPLICANT: COMMUNITY DEVELOPMENT COMMISSION CASE FILE NUMBERS: LCP-2004-1, GPA-2004-5 AND ZC-2004-2 WHEREAS, the Community Development Commission of the City of National City is requesting the approval of a Local Coastal Program Amendment (Case File No. LCP-2004-1) and an Amendment to the Combined General Plan/Zoning Map (Case File No. GPA-2004-5 and ZC-2004-2) for Marina Gateway Place within the National City Harbor District, which includes the area generally bound by Interstate 5 on the east, Bay Marina Drive on the south, the San Diego & Arizona Eastern railroad right- of-way on the west, and 22"d Street on the north, and comprises approximately 5.5 acres; and WHEREAS, on February 7, 2005, the Planning Commission of the City of National City, California, conducted a duly advertised public hearing to consider said request, and at which time, after considering oral and documentary evidence, the Planning Commission recommended that the City Council approve the proposed Marina Gateway Place Project; and WHEREAS, the City Council of the City of National City, California, conducted a duly advertised public hearing to consider said request, at which time, the City Council considered oral and documentary evidence; and WHEREAS, at said public hearing the City Council considered the staff report contained in Case File Nos. LCP-2004-1, GPA-2004-5 and ZC-2004-2 which are maintained by the City and incorporated herein by reference; along with evidence and testimony at said hearing; and WHEREAS, a Notice of Exemption has been prepared, pursuant to the requirements of the California Environmental Quality Act for the proposed Marina Gateway Place Project; and WHEREAS, this action is taken pursuant to all applicable procedures required by State Law and City Law; and WHEREAS, the action hereby taken is found to be essential for the preservation of the public health, safety and general welfare. Resolution No. 2005 —115 June 7, 2004 Page 2 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of National City that the testimony and evidence introduced in the staff report and public hearing for said Local Coastal Program Amendment support the following findings: 1. The Local Coast Program Amendment is categorically exempt from the California Environmental Quality Act, pursuant to the regulations and guidelines of the California Coastal Commission; and approve the exemption. 2. The Local Coastal Program Amendment and corresponding General Plan Amendment/Zone Change for Marina Gateway Place is categorically exempt pursuant to Section 15061(b)(3) of the California Environmental Quality Act; and approve the exemption. 3. The amendment to the Local Coastal Program Land Use Plan is in the public interest and consistent with Coastal Act policies; since it calls for a transition from existing industrial uses to future tourist commercial uses to provide a gateway to the Bayfront. The overall planning concept for Marina Gateway Place is as a transition zone in order to unite and serve the existing and proposed land uses. The goal of this transition zone is to provide both an aesthetic as well as a functional link between the industrial uses to the north and recreational and tourist commercial uses to the south. Marina Gateway Place will also provide an inviting entry for all those traveling to the National City Harbor District. Additionally, Marina Gateway Place will provide a blend of services and land uses for those working, living or playing in the area. 4. The amendment to the Local Coastal Program Implementation is consistent with and carries out the Local Coastal Program Land Use Plan, as amended, since it adds regulations to guide tourist commercial development within Marina Gateway Place that is compatible with the proposed development within the National City Harbor District, and specifically the area south of Bay Marina Drive. Additionally, the implementation of Marina Gateway Place will establish the point of entry "gateway" as called out for in the National City Local Coastal Program. BE IT FURTHER RESOLVED by the City Council of the City of National City that the testimony and evidence introduced in the staff report and public hearing for said Amendment to the Combined General Plan/Zoning Map support the following findings: 1. Find that the Amendment to the Combined General Plan/Zoning Map is categorically exempt pursuant to Section 15061(b)(3) of the California Environmental Quality Act; and approve the exemption. Find that the Amendment to the Combined General Plan/Zoning Map, as part of the proposed Local Coastal Program Amendment, is in the public interest and are consistent with General Plan policies, since it will facilitate new development by allowing greater flexibility to introduce tourist commercial land uses while still ensuring high quality design that is compatible with the redevelopment of the National City Harbor District. 3. Find that the Amendment to the Combined General Plan/Zoning Map is consistent with and necessary to implement the General Plan, since it adds regulations to guide tourist commercial development within Marina Gateway Place that is compatible with the proposed development within the National City Harbor District, and specifically the area south of Bay Marina Drive. BE IT FURTHER RESOLVED that based on the findings hereinbefore stated, the City Council of the City of National City hereby approves said Local Coastal Program Amendment and Amendment to the Combined General Plan/Zoning Map for the Marina Gateway Place Project.
