Ila, CMC City Clerk of the City of National City No 4- Ad:whet RESOLUTION NO. 2006 — 177 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY DENYING THE APPLICATION TO VACATE THE SOUTHERN PORTION OF EAST 15TH STREET, EAST OF NATIONAL CITY BOULEVARD AND WEST OF KIMBALL PARK, AND THE ALLEY VACATION SOUTH OF EAST 15TH STREET, NORTH OF EAST 16TH STREET, EAST OF NATIONAL CITY BOULEVARD AND WEST OF KIMBALL PARK CASE FILE NO. SC 2006-3 WHEREAS, at the meeting held on August 22, 2006, the City Council considered a Street and Alley Vacation Application to close the southern portion of 15th Street, east of National City Boulevard and west of Kimball Park, and the alley south of 15th Street, north of 16th Street, east of National City Boulevard and west of Kimball Park, at which time the City Council took testimony and deliberated whether the proposed street vacation conformed with the General Plan; and WHEREAS, the Planning Commission, at their meeting held on July 17, 2006, considered a Street and Alley Vacation Application to close the southern portion of 15th Street, east of National City Boulevard and west of Kimball Park, and the Alley south of 15th Street, north of 16th Street, east of National City Boulevard and West of Kimball Park, at which time the Planning Commission took testimony and deliberated whether the proposed street vacation conformed with the General Plan; and WHEREAS, the Planning Commission, at their meeting held on July 17, 2006, adopted Resolution No. 23-2006, which reported that the proposed street vacation did not conform with both the General Plan and Downtown Specific Plan; and WHEREAS, concerns were raised about eliminating vehicle access to the parking area near the basketball courts and baseball fields at Kimball Park; and WHEREAS, concerns were raised about removing the on -street parking abutting the Library on 15th Street reducing the supply of parking available to users of the Library; and WHEREAS, concerns were raised about traffic safety because the vehicular access to the Library would be solely on National City Boulevard; and WHEREAS, concerns were raised about pedestrian safety in the Library parking lot and National City Boulevard, should a second driveway be installed on National City Boulevard to allow vehicular access to the Library; and WHEREAS, this action is taken pursuant to all applicable procedures required by State and City law. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of National City that 15th Street is necessary for present or prospective use. Resolution No. 2006 — 177 August 22, 2006 Page 2 BE IT FURTHER RESOLVED that the City Council denies the application to vacate the southern portion of East 15th Street, east of National City Boulevard and west of Kimball Park, and the Alley Vacation south of East 15th Street, north of East 16th Street, east of National City Boulevard and west of Kimball Park.
