WHEREAS, application was made for app al of i'ntative Subdivision Map

WHEREAS, the'fning Commission of the City of National City considered
said applications at a,c#vertised public hearing held on April 6, 2009, at which time the
Planning Commissi consited oral and documentary evidence; and
NAtigRAAS,. said public hearing the Planning Commission considered the staff
report provided forse'ie No. 2007-59 S, IS, Z, which is maintained by the City and
incorporateckference; along with evidence and testimony at said hearing; and
recommended`nial of the proposed Tentative Subdivision Map with exceptions, variance, and
underground wat eq ..uest, and
WHEREAS, this action is taken pursuant to all applicable procedures required by
State and City law; and
WHEREAS, the action hereby taken is found to be essential for the preservation
of the public health, safety and general welfare.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
National City that the testimony and evidence presented to the City Council at the public hearing
held on May 5, 2009, denied the Tentative Subdivision Map with exceptions, variance, and
waiver of undergrounding based on the following findings:

1. The proposed subdivision map would have a significant effect on the surrounding
neighborhood since the proposed seven parcels would result in a development at
a density of 9.85 dwelling units per acre which is greater than the permitted
density of 8.7 dwelling units per acre, and four lots with significantly smaller than
the 5,000 square foot minimum lot size within the Resident ' le-Family-3
(RS-3 zone), which would have the potential to diminish,,e charaer of the
neighborhood of predominantly single-family residencgs d` iinim.n 5,000
square foot parcels.
2. The proposed exceptions for reduced lot size, rei1=;�treerontage, and
reduced lot width are excessive in allowance xcep' } "nd would result in an
increase in allowable density for the RS-3 zgANAd the tot sizes would be
inconsistent with surrounding developmen.Fiat ref parcel sizes typical of the
RS-3 zone, and the proposed developm eludes three lots with 2,790 square
feet each and one lot of 3,255 square i d would not comply with the intent
of the Subdivision Ordinance.
3. The property is not so unduly cor trainei#€ ytbpography and/or configuration
that would deprive the property c4ner's a ity to develop the property in a
similar, less divergent manna , orl r ding properties by adhering to the
Land Use Code, and that t `ir ss elopment might affect the stability of
the neighborhood and q ty of life*since it would introduce three story

BE1W ER RESOLVED that the City Council has considered the proposed
Tentative S gyp, exceptions, variances, and waiver of undergrounding (Case No.
2007-59 S, IS' ,requested by the applicant, together with any comments received during the
public review pros, and finds on the basis of the whole record finds that the project will have
a significant adverse effect on the preservation of the public health, safety, and general welfare,
and denies the proposed development.
BE IT FURTHER RESOLVED that copies of this Resolution be transmitted
forthwith to the applicant.
