RESOLUTION APPROVING TENTATIVE SUBDIVISION
MAP - SOUTH BAY GARDEN TOWNHOMES, 225 E
26th STREET. (s-3-79)
BE IT RESOLVED by the City Council of the
City of National City that the tentative subdivision
map for South Bay Garden Townhomes, 225 E. 26th Street
be approved subject to the following conditions:
1. The final map shall indicate that this
is a condominium project.
2. Monumentation found and set, and bearings
and distances shall be indicated on the final map.
3. A copy of the agreement to serve from the
Sweetwater Authority shall be on file prior to approval
of the final map.
4. A street light design by the San Diego
Gas and Electric Company shall be provided and approved
by the City Engineer.
5. A grading plan, conforming to Section 70
of the Uniform Building Code and the National City Land
Use Code, shall be approved prior to final map -approval.
6. All utilities are to be undergrounded.
7. A detailed soils engineering and engineer-
ing geology report, prepared by a registered geologist,
containing recommended grading procedures and specifica-
tions shall be submitted prior to the approval of the
final map.
8. All soils work shall be done under th.e
direction of a soils engineer and geologist.
9. Sewer fees, to connect to the existing
sewer in 26th Street, shall be determined by the Director
of Building and Housing and shall be paid the time the
building permits are issued.
10. Existing and proposed easements shall be
shown on the final map.
11. Fees for interim school facilities in the
amount of $150 per bedroom in each unit shall be paid
at the time buidling permits are approved and issued,
pursuant to National City Ordinance No. 1622, unless
the Covenants, Conditions and Restrictions as approved
by the City Attorney of National City, limit this
condominum subdivision to adults only.
12. Park fees of $125 per unit shall be paid
at the time building permits are approved and issued.
13. Maximum slope grade within the project
boundary and for any off -site grading shall be 2:1.
14. Prior to the approval of the final map,
a landscape plan, prepared by a licensed landscape
architect, shall be approved by the city. All areas
designated as areas of useable open space shall be shown
on the landscape plan and shall be improved with land-
scaping, pedestrian walkways and other facilities or
structures which are limited to recreational use for the
permanent use and enjoyment of all owners and/or resi-
dents of the development. Slope banks, including those
created in any off -site grading, shall be stabilized
with an approved combination of soil -binding ground -
cover, shrubs and trees. A permanent, underground, auto-
matic irrigation system shall be in the landscape plan.
15. Prior to th.e filing of the final map, the
following documents shall be filed with and approved by
the National City Planning Department.
a. Diagrammatic floor plans
b. Consent to record.
16. Maintenance of slopes, common areas and
areas of useable open space for the subdivision shall
be the responsibility of the Homeowners' Association
and shall be provided for in the Covenants, Conditions
and Restrictions.
17. Prior to the filing of the final map, a
copy of th.e Covenants, Conditions and Restrictions shall
be filed with and approved by the City Attorney of National
City.
18. The Covenants, Conditions and Restrictions
shall:
a. Clearly specify a "level of Maintenance"
to be expected of all landscaped areas and suitable
measures to guarantee compliance therewith by the
Homeowners' Association.
b. Provide that the City may. enter the
property and perform necessary maintenance work and place
a tax lien on the property to cover the costs thereof.
c. Provide for the maintenance of and
continued unobstructed access to fire protection equip-
ment and life safety systems and appliances per City
Ordinance 1591 and Uniform Fire Code Sections 13.206,
13.207, 13.208 (a) through (e) and 13.302 (a) and (b)
as required by the City of National City Fire Department.
19. Water mains and fire hydrants shall be
provided, capable of yielding a fire flow of no less than
2,500 G.P.M. for a duration of four (4) hours with no
less than a 20 P.S.I. residual pressure. Hydrants shall
be approved as to number and location by the Fire Chief
and installed prior to building construction. Fire
access must be approved by the Fire Chief and approved
prior to issuance of a building permit.
20. All conditions of approval of Planned
Unit Development Permit PUD 10-79 shall also become
conditions of approval for the tentative subdivision map.
21. All conditions of the entire tentative map
must be satisfied before the final map for the proposed
condominium project can be approved.
