HomeMy WebLinkAboutCC RESO 13,209RESOLUTION NO. 13,209 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA, DENYING AN APPLICATION FOR CONDITIONAL USE PERMIT TO ALLOW AN OFFICE OF THE STATE OF CALIFORNIA, DEPARTMENT OF EMPLOY- MENT AND DEVELOPMENT (PUBLIC SERVICE AGENCY) ON PROPERTY LOCATED AT 906 THRU 914 EAST EIGHTH STREET The City Council of the City of National City, California, resolves as follows: WHEREAS, this action is taken pursuant to all applicable procedures required by State and City law; and WHEREAS, the entire contents of Case File No. CUP-1979-10, maintained by the City, are attached to and made part hereof, by reference; and, WHEREAS, the action recited herein is found to be essential for the preservation of public health, safety, and general welfare; and WHEREAS, testimony and evidence presented to this Council at a properly noticed public hearing failed to support a finding; A. That the site for the proposed use is adequate in size and shape; having insuf- ficient setback from neighboring residences, and having insufficient ground floor level off-street parking. B. That the site has sufficient access to streets and highways that are adequate in width and pavement type to carry the qual- ity of traffic generated by the proposed use; based upon the known experience record of traffic congestion and physical hazard upon public streets in the immediate vicinity, as shown in Police Department, Engineering Department, and Traffic Safety Commission records. C. That the proposed use will not have an adverse effect upon adjacent or abutting properties; due to probability of substantial land use conflict between the adjoining residential uses and the quasi commercial nature of the proposed facility, with its features of traffic, assemblages of people and architectural impacts. NOW, THEREFORE, BE IT RESOLVED THAT this application is denied for the reason that the proposed use will have an adverse effect upon adjacent or abutting properties, and the site does not have sufficient access to streets and highways in a manner that will avoid extraordinary traffic hazards.
