RESOLUTION NO. 13,021 A RESOLUTION OF THE CITY OF NATIONAL CITY AMENDING CONTRACT FOR PROFESSIONAL AND TECHNICAL SERVICES WHEREAS, on June 20, 1978 the City Council of National City adopted Resolution 12,769 authorizing execution of a contract for Professional and Technical Service with Van Dyke/Halsey Design Group for the design and development of Kimball Park Phase II and IIIb, and WHEREAS, it is now necessary to amend said contract by providing for full inspection services; NOW, THEREFORE, BE IT RESOLVED, as follows: SECTION 1. Contract Item 1.A. (2) "construction period service" is hereby revised to include full inspection service by the architect during the construction period as follows: 5 days per week, 4 hours/day 18 weeks The architect will inspect all construction on- site initially, review and recommend all change orders, subject to City approval. SECTION 2. Contract Item 3.B. is hereby increased to $14,400.00. PASSED AND ADOPTED this 10th day of April, 1979. ATTEST: CITY OF NATIONAL CITY AMENDMENT TO CONTRACT FOR PROFESSIONAL AND TECHNICAL SERVICES The original contract entered into on the 27th day of June, 1978 by and between the City of National City, California and Van Dyke/Halsey Design Group, Inc. is amended this 10th day of April, 1979 as follows: 1. Scope of Services (2) Construction Period Service: 1. The Construction Phase will commence with the award of this construc- tion contract and will terminate when the project is accepted by the City. 2. The Landscape Architect shall make an average of (3) scheduled inspections per week and during the construction period or as required to the project to ascertain that the work is being execu- ted in conformity with the working drawings, specifications and direction; advise as to the true intent of the plans and specifica- tions for the construction of the project and make reports as necessary. 3. The Landscape Architect shall keep the City informed of the'progress of construction and report any deficiencies in the work of construc- tion; check and approve schedules, materials lists, shop drawings and laboratory reports for compliance with design; approve materials, equipment, and laboratory reports; inspect/approve trench depths, coverage tests and pressure test irrigation mains; direct placing and positioning of all specimen trees; inspect finish grades and place- ment of fillsoil; inspection to establish Maintenance Period; final inspection upon completion of Maintenance; prepare change orders for written approval; examine Contractor's applications for payment; approve partial payments to Contractor in accordance with the Con- tract and advise the City when to issue certificates for such pay- ments. The installation of irrigation system, planting, flatwork (concrete and A.C. surfacing), grading, tennis courts, multi purpose court, fencing and demolition work shall be the majority of work required by the Landscape Architect to inspect and supervise and the City Engineer shall be responsible for inspections of restroom resto- ration, sewer, storm drain, retaining walls and electrical installa- tion, which are not covered under the Landscape Architect's laws to inspect and supervise. 4. The Landscape Architect shall be the interpreter of the requirements of these Construction Documents and the impartial judge of the per- formance of the Contractor thereunder. The Landscape Architect shall make decisions on claims relating to the execution and progress of the work and all matters and questions relating to artistic effect shall be consistent with the intent of the Construction Documents.a 5. The Landscape Architect shall promptly inform the City whenever in his opinion, it may be necessary to stop the work to avoid the'.im proper performance of the contract. 6. The Landscape Architect shall not issue orders to Contractors that might commit the City to extra expenses or otherwise amend the con- struction contract without first obtaining the written approval of the City. 7. The Landscape Architect shall use his best efforts to secure compli- ance by the Contractor with the contract requirements, but he is not responsible for the acts or omissions of the Contractor or any work on the project which are not due to the Landscape Architect's neg- ligence. • (3) Compensation B. Item 1.A, (2) Construction Period Services Compensation for item 1.A, (2) shall be based on fee schedule as amended in Section 3.A (2) above. Maximum compensation under the section shall be $14,400.00. In witness whereof, the City and the Landscape Architect have amended said original agreement as of the date above written..
