HomeMy WebLinkAboutCC RESO 12,628RESOLUTION NO. 12,628 RESOLUTION ORDERING PROPOSED REORGANIZATION INVOLVING THE CITY OF NATIONAL CITY, THE SAN DIEGO COUNTY FLOOD CONTROL DISTRICT - ZONE 3, AND THE LOWER SWEETWATER FIRE PROTECTION DISTRICT "F" AVENUE REORGANIZATION" WHEREAS, on November 7, 1977 the Local Agency Formation Commission approved the proposed "F" Avenue Reorganization consisting of the following: 1. Annexation of territory described in Exhibit "A" (attached hereto) to the City of National City. 2. Detachment of the territory described in Exhibit "A" (attached hereto) from San Diego County Flood Control District - Zone 3, and 3. Detachment of the territory described in Exhibit "A" (attached hereto) from the Lower Sweetwater Fire Protection District. WHEREAS, pursuant to Government Code Section 56271.1, the Local Agency Formation Commission authorized the City of National City to initiate reorganization proceedings in compliance with Government Code Section 56430 et seq., and WHEREAS, pursuant to Government Code Section 56431 the City Clerk of the City of National City set a public hearing on the proposed reorganization for December 20, 1977 and gave notice of the date, time, and place of said hearing in accordance with Government Code Section 56432, and WHEREAS, the hearing on the proposed reorgani- zation was held on the date and at the time and place set therefor, and due notice of said hearing was given in the manner required by law, and WHEREAS, no written protest to the proposed reorganization was received at said hearing; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of National City does hereby order the proposed reorganization consisting of the annexation of the territory described in Exhibit "A", attached hereto, to the City of National City, detachment of the territory described in Exhibit "A", attached hereto, from the San Diego County Flood Control District - Zone 3, and detachment of the territory described in Exhibit "A", attached hereto, from the Lower Sweetwater Fire Protection District, subject to the condition as stated on Exhibit "B", attached hereto and incorporated herein. PASSED AND ADOPTED this 17th day of January, 1978. ATTEST: R077-2 Proposed "F Avenue Reorganization" All those portions of Lo.t 9, Lot 10 and Lot 11 of quarter section 152, Rancho De La Nacion in the County of San Diego, State of California according to Map thereof No. 166, filed in the County Recorder's office of San Diego County May 11, 1869, lying within the following described boundaries: Commencing at the northwesterly corner of the easterly half of the westerly half of 10 acre Lot 10 of said quarter section 152; thence southerly along the westerly line of said easterly half of the westerly half to the northerly line of 10 acre Lot 9; thence easterly along said northerly line of said 10 acre Lot 9 to a line which is parallel with and 155 feet westerly of the centerline of "F" Avenue, as shown on Road Survey Number 597 map on file in the County Engineer's office of said County; thence southerly along said parallel line, a distance of 150 feet; thence easterly, parallel with the southerly line of said quarter section 152, to said centerline of "F" Avenue; thence southerly along saidcenterline to the southerly line of said quarter section 152; thence easterly along said southerly line of said quarter section 152 to the easterly line of the westerly half of the easterly half of said 10 acre Lot 9; thence northerly along said easterly line 205 feet more or less to a line parallel with and 125 feet southerly of the northerly line of said 10 acre Lot 9; thence westerly 20 feet parallel with the southerly line of said quarter section 152; thence northerly, parallel with said easterly line of the westerly half of the easterly half of said 10 acre Lot 9 and its northerly prolongation 170 feet.; thence easterly 20 feet more or less parallel with the southerly line of said 10 acre Lot 10 to the easterly line of the westerly half of the easterly half of said 10 Acre Lot 10; thence northerly along said easterly line to the northerly line of said 10 acre Lot 10; thence continuing northerly, along the northerly prolongation of said easterly line of said westerly half of said easterly half of said 10 acre Lpt 10; 40 feet; thence westerly parallel with the northerly line of said 10 acre Lot 10 to the northerly prolongation of the westerly line of the easterly half of the westerly half of said 10 acre Lot 10; thence southerly along said northerly prolongation of said westerly line of said easterly half of said westerly half of said 10 acre Lot 10 to the point of commencement. rm:dg 9/30/77 LAFCO EXHIBIT "A".. The description of the boundaries shall be modified to conform to Exhibit •'A"attached hereto. 2. The Lower Sweetwater Fire Protection District shall be exempt from the Health and Safety Code § 13954 requirement to redistribute its property and unencumbered funds to the City of National City.
