HomeMy WebLinkAboutCC RESO 12,685RESOLUTION NO. 12,685 RESOLUTION GRANTING A PLANNED DEVELOPMENT PERMIT PURSUANT TO ORDINANCE 1077 (PUD-1-77, to allow development of a 140-unit planned unit development [residential] on property located on East 24th Street, west of Newell Avenue and adjacent to Las Palmas Park) The City Council of the City of National City, California does hereby find, determine, order and resolve as follows: 1. At a regular meeting of the City Planning Commission on February 13, 1978, said Commission unanimously adopted a recommendation that the owner of the real property at East 24th Street, west of Newell Avenue and adjacent to Las Palmas Park and more fully described in Exhibit "A" attached hereto and made a part hereof as though set forth in full, be granted a Planned Development Permit upon the conditions hereinafter stated. 2. That the City Council has received the rec- ommendation of the Planning Commission, and after full and complete consideration of said recommendation hereby grants a Planned Development Permit to allow development of a 140- unit planned unit development [residential] at East 24th Street, west of Newell Avenue and adjacent to Las Palmas Park, subject to the following conditions: a. Before this planned unit development permit shall become effective, the following shall be satisfied: 1) Evidence shall be submitted to the Planning Department that all property included in this PUD permit is under one ownership; and 2) A subdivision map shall be approved by the City. b. Development shall be in accordance with submitted plans except as noted herein. 1) Maximum number of dwelling units shall not exceed 140. 2) All required off-street parking spaces shall have minimum dimensions of 9 feet by 19 feet. 3) Site drainage shall be provided at not less than one percent (1%). 4) Transitions shall be provided in accord- ance with the provisions of Section 18.58.470 of the Land Use Code for 15 percent grade at southerly entrance on Newell Street. c. Development plans submitted for the issuance of a building permit shall be subject to Chapter 18.128, National City Land Use Code (Site Plan Review). d. Landscape and irrigation plan for the entire project shall be prepared by a qualified landscape architect. 1) Irrigation system shall be provided with automatic controls. 2) Landscape plan shall show pedestrian walkways, a minimum of 30" in width and graded or ramped to no steeper than a 1 to 12 slope. e. All applicable provisions of Chapter 18.30, National City Municipal Code, shall be sat- isfied prior to issuance of a building permit. 1) Building permits shall be obtained within a period of time not to exceed one (1) year from effective date of planned unit development permit. f. Relocate one fire hydrant at northwest corner of project as recommended by the Fire Chief. Fire water main shall be looped and fire flow shall be no less than 2,000 GPM. h. Fire Department apparatus access from north to south parking areas shall be no less than 20 feet wide. g• i. This permit shall apply only to a "condo- minium" project which has been approved and recorded as a subdivision. j. The sale of this project and the CC & R's shall be designed to discourage "speculative" investments and ownerships. k. CC & R's shall include provision to prohibit parking on 24-foot wide private streets. and, the following deviations from the zoning regulations shall be allowed: a. Front yard setbacks vary. Minimum distance shown is 5 feet. Land Use Code requires 20 feet. b. Rear yard setbacks vary. Minimum distance shown is 6 feet. Land Use Code requires 25 feet. c. Distance shown for units facing a side or rear yard is 10 feet. Land Use Code requires a minimum of 15 feet. d. Off-street parking shown that is adequate in dimension (9'x19') represents a ratio of 1.58 spaces per dwelling unit Land Use Code (PUD) requires a ratio of 2 spaces per dwelling unit.
