HomeMy WebLinkAboutCC RESO 12,792RESOLUTION NO. 12,792 ,v A RESOLUTION ADOPTING AN AMENDMENT TO APPENDIX "D" OF THE LAND USE CODE, TO ADD"NON-PROFIT THRIFT STORE OPERATED AS AN ADJUNCT TO A USE PERMITTED IN USE GROUP 8 AND WHEN LOCATED IN THE IP ZONE" TO USE GROUP 8 WHEREAS, the Planning Commission at their meeting of May 8, 1978, was unable to make a finding, by interpretation, that "non-profit thrift store oper- ated as an adjunct to a use permitted in this use group (8) and when located in the IP zone" was of reasonably certain likeness to other uses in Use Group 8 of Appendix "D" of the Municipal Code, and WHEREAS, the Planning Commission initiated proceedings pursuant to Section 18.136.070 of the Municipal Code to add "Non-profit Thrift Store Operated as an Adjunct to a Use Permitted in this Use Group When Located in the IP Zone" to Appendix "D" as a permitted use in Use Group 8 with a Conditional Use Permit, and WHEREAS, the Planning Commission at their meeting of June 12, 1978, found that "non-profit thrift store operated as an adjunct to a use permitted in this zone when located in the IP zone" (conditional use permit required) falls within the intent of Section 18.104.120 of the Municipal Code (Land Use Code, Title 18) and adopted a recommendation to the City Council that Appendix "D" of the Municipal Code (Land Use Code) be amended to add the aforesaid use, and WHEREAS, the City Council considered and approved the Planning Commission recommendation at their meeting of June 20, 1978; NOW, THEREFORE, BE IT RESOLVED as follows: 1. That "Appendix "D" of the Municipal Code is amended to include the use "Non-profit Thrift Store Operated as an Adjunct to an Approved Use in This Use Group When Located in the IP Zone" as a permitted use in Use Group 8. 1978.
