RESOLUTION GRANTING ZONE VARIANCE PURSUANT TO
THE LAND USE CODE OF THE CITY OF NATIONAL CITY
(Z-9-78, to allow a maximum driveway slope of 17.875%
in lieu of the 15% maximum allowed by the Land Use Code
at 940 Palm Avenue - Fred Meyer)
The City Council of the City of National City
does hereby find, determine, order and resolve as follows:
1. That practical difficulties, unnecessary
hardship and a result inconsistent with the general purpose
and intent of the Land Use Code of the City of National
City would occur through strict application of the pro-
visions of said Code to that certain real property here-
inafter described.
2. That a Petition requesting a variance has
been filed pursuant to the provisions of the Land Use
Code and said petition complies with all the requirements
of said Code.
3. That the National City Planning Commission
did hold a hearing on said Petition and did recommend to
the City Council that a variance be granted.
4. That the granting of a variance with reference
to the property hereinafter described will not defeat, but
rather will carry out the general intent and purpose of the
National City Land Use Code, will provide for the public
safety and welfare and will administer substantial justice.
5. That a variance from the provisions of said
Land Use Code be and hereby is granted with reference to
all the certain real property situated in the City of
National City, California, more particularly described
as follows:
ASSESSOR'S PARCEL NO. 557-180-18 & 557-250-09
The Southerly 331 feet of the Northerly 826
feet of the Westerly 300 feet of the Easterly
330 feet of 40 Acre Lot 1 of Quarter Section
132 of Rancho De La Nacion, per Map thereof
Number 166 on file in the Office of the County
Recorder of San Diego County, California, May
11, 1869. EXCEPTING THEREFROM the Easterly
150 feet of the Southerly 75 feet and ALSO
EXCEPTING THEREFROM the Easterly 135 feet
of the Northerly 82.50 feet of the Southerly
166 feet.
6. That the variance hereby granted is as
follows: To allow a maximum driveway slope of 17.875%
in lieu of the 15% maximum allowed by the Land Use Code
at 940 Palm Avenue.
PASSED AND ADOPTED this 1st day of August,
1978.
