HomeMy WebLinkAboutCC RESO 12,840RESOLUTION NO. 12,840 RESOLUTION GRANTING ZONE VARIANCE PURSUANT TO THE LAND USE CODE OF THE CITY OF NATIONAL CITY (Z-6-78, to allow reduction in required setbacks in conjunction with the proposed development of a 41-unit motel on property located between Roosevelt and National City Boulevard, 600 block - Harold Dodds, Inc.) The City Council of the City of National City does hereby find, determine, order and resolve as follows: 1. That practical difficulties, unnecessary hardship and a result inconsistent with the general purpose and intent of the Land Use Code of the City of National City would occur through strict application of the pro- visions of said Code to that certain real property here- inafter described. 2. That a Petition requesting a variance has been filed pursuant to the provisions of the Land Use Code and said petition complies with all the requirements of said Code. 3. That the National City Planning Commission did hold a hearing on said Petition and did recommend to the City Council that a variance be granted. 4. That the granting of a variance with reference to the property hereinafter described will not defeat, but rather will carry out the general intent and purpose of the National City Land Use Code, will provide for the public safety and welfare and will administer substantial justice. 5. That a variance from the provisions of said Land Use Code be and hereby is granted with reference to all the certain real property situated in the City of National City, California, more particularly described as follows: All that portion of Block 7 of the. Map of National City, number 348, filed with the County Recorder of San Diego County, California, October 2, 1882, described as follows: All of Lots 1 through and including Lot 4; together with all of Lots 19 through and including Lot 24; together with the Westerly 45 feet of Lot 18; together with the Westerly 45 feet of the Northerly 10 feet of Lot 17. 6. That the variance hereby granted is as follows: To allow reduction in required setbacks in con- junction with the proposed development of a 41-unit motel on property located between Roosevelt and National City Boulevard, 600 block, subject to the following conditions: a. Prior to Resolution granting zone variance becoming effective, the parcel map required in conjunction with this development shall be finalized. b. All areas of reduced setback, required to be landscaped, shall be planted with specimen type plant materials. c. A building permit shall be obtained within a period of time not to exceed one year from the effective date of resolution granting variance. PASSED AND ADOPTED this 12th day of September, 1978.
