RESOLUTION GRANTING ZONE VARIANCE PURSUANT TO
THE LAND USE CODE OF THE CITY OF NATIONAL CITY
(Z-14-78, to allow division of property that will create
a lot with 20' of frontage in lieu of required 50' on
property located on west side of Cagle Street between
Stockman Street and Freeway 54)
The City Council of the City of National City
does hereby find, determine, order and resolve as follows:
1. That practical difficulties, unnecessary
hardship and a result inconsistent with the general purpose
and intent of the Land Use Code of the City of National
City would occur through strict application of the pro-
visions of said Code to that certain real property here-
inafter described.
2. That a Petition requesting a variance has
been filed pursuant to the provisions of the Land Use
Code and said petition complies with all the requirements
of said Code.
3. That the National City Planning Commission
did hold a hearing on said Petition and did recommend to
the City Council that a variance be granted.
4. That the granting of a variance with refer-
ence to the property hereinafter described will not defeat,
but rather will carry out the general intent. and purpose
of the National City Land Use Code, will provide for the
public safety and welfare and will administer substantial
justice.
5. That a variance from the provisions of said
Land Use Code be and hereby is granted with reference to
all the certain real property situated in the City of
National City, California, more particularly described as
follows:
All that portion of the Easterly Half of Quarter
Section 100 of Rancho De La Nacion, in the County
of San Diego, State of California, according to
Map thereof Number 166, filed in the County
Recorders Office, described as follows: Commenc-
ing at the Northeasterly corner of Lot 25 of
Sweetwater Mesa Unit Number 1 per Map thereof
number 6821, as said Map is filed with said
County Recorder; Thence South 82°07'05" East,
257.97 feet to a point on a 1136 foot radius curve,
concave Northwesterly, a radial line bears North
66°17'57" West, thence Southerly along the arc
of said curve, through a central angle of 4°02'06",
a distance of 80 fee•t to the Northeasterly corner
of Lot 22 of said Sweetwater Mesa Unit Number 1;
Thence North 75°31'48" West, 230.96 feet; Thence
North 3°14'26" East, 49.80 feet to the point of
Commencement.
6. That the variance hereby granted is as
follows: To allow the division of property (lot split)
that will create a lot with 20 feet of frontage in lieu
of the required 50 feet on property located on the west
side of Cagle Street between Stockman Street and Freeway
54 (Assessor's Parcel No. 564-290-22), subject to the
following condition:
a. That division of property shall be in
accordance with submitted plan.
PASSED AND ADOPTED this 24th day of October,
1978.
