HomeMy WebLinkAboutCC RESO 12,268RESOLUTION NO. 12,268 VACATION OF 25TH STREET BETWEEN THE WESTERLY LINE OF CLEVELAND AVENUE TO THE EASTERLY LINE OF HARRISON AVENUE, AND CLEVELAND AVENUE FROM THE SOUTHERLY LINE OF 24TH STREET TO THE SOUTHERLY LINE OF 25TH STREET BE IT RESOLVED, by the Council of the City of National City, California, that 25th Street between the Westerly line of Cleveland Avenue to the Easterly line of Harrison Avenue, and Cleveland Avenue from the — Southerly line of 24th Street to the Southerly line of 25th Street as more particularly referred to in Resolu- tion of Intention No. 11,553 is unnecessary for present or prospective public street purposes BE IT FURTHER RESOLVED, that the public inter- est, convenience and necessity of said City requires the reservation of a certain public easement, as more particularly referred to in Resolution of Intention No. 11,553. BE IT FURTHER RESOLVED, that 25th Street between the Westerly line of Cleveland Avenue to the Easterly line of Harrison Avenue, and Cleveland Avenue from the Southerly line of 24th Street to the Southerly line of 25th Street as more particularly described in Resolution of Intention No. 11,553, which said Resolution is attached hereto and made a part hereof, be, and the same is hereby vacated. BE IT FURTHER RESOLVED, that the City of National City reserves and excepts from the foregoing vacation the permanent easement as more particularly described hereinafter: Reserving and excepting to the City of National City the right, easement and privilege of placing, con- structing, repairing, replacing, maintaining, using, and operating public utilities of any kind or nature, including, but not limited to sewer, water, and drainage, and all necessary and proper fixtures and equipment for the use in connection therewith, through, over, under, upon, along and across all the portions or parts of the here- inafter described easement. Also reserving and excepting from the vacation, subject and subordinate to the aforementioned easement to the City of National City, the permanent right at any time, or from time to time, pursuant to any franchise or renewal thereof, for and on behalf of the San Diego Gas & Electric Company, the Pacific Telephone and Telegraph Company and the California American Water Company, or any other utility company operating under a municipal or state franchise with the City of National City, to con- struct, maintain, operate, replace, remove, and renew lines of pipe, conduits, cables, wires, poles, and other related structures, including the necessary use of equip- ment and fixtures for the operationofgas pipe lines, telegraphic and telephone lines, and for the transportation or distribution of electric energy, through, over, under, upon, along and across all portions of the hereinafter described easement: The easements and rights hereinabove reserved and excepted shall include the right of ingress thereto and egress therefrom, together with the right to maintain the said easement free and clear of any excavation or fills, the erection or construction of any building or other structures, the planting of any tree or trees thereon, or the drilling or digging of any well or wells thereon, together with the right to otherwise protect from all hazards the operation and use of any right hereby reserved. Upon wirtten permission of the City and of any public utility listed heretofore, the owners of the under- lying fee may utilize the above described parcel of land for structures, approved plantings, the installation of privately owned pipelines, and/or other approved usages. The easement reserved herein is in, under, over, upon, along and across that portion of 25th Street between the Westerly line of Cleveland Avenue to the Easterly line of Harrison Avenue, and Cleveland Avenue from the Southerly line of 24th Street to the Southerly line of 25th Street vacated by this document and as more particularly described in Resolution of Intention No. 11,553, attached hereto. BE IT FURTHER RESOLVED, that the City Clerk shall cause a certified copy of the Order of Vacation to be recorded in the office of the County Recorder of San Diego County, pursuant to Section 8324, California Highways Code. PASSED AND ADOPTED this 22nd day of February, 1977. ATTEST: RESOLUTION NO. 11,553 RESOLUTION GIVING NOTICE OF INTENTION TO VACATE AND CLOSE 25T8 STREET BETWEEN THE WESTERLY LINE OF CLEVELAND TO THE EASTERLY LINE OF HARRISON AVENUE, AND CLEVELAND AVENUE FROM THE SOUTHERLY LINE OF 24TH STREET TO THE SOUTHERLY LIME or 25TH STREET The City Council of the City of National City, California, hereby declares its intention to vacate and close, pursuant to the provisions of Part 3 of Division 9 of the Streets and Highways Code of California, 25th Street between the westerly line of Cleveland to the easterly line of Harrison Avenue, and Cleveland Avenue from the southerly line of 24th Street to the southerly line of 25th Street, situated in the City of National City, County of San Diego, State of California described as follows: All that portion of Twenty-fifth Street adjacent to Block 281 and 282 lying between the easterly line of Harrison. Avenue (formerly Ninth Avenue) and the westerly line of Cleveland Avenue (formerly Eighth Avenue) adjacent to Block 281 and vacated forty foot street adjacent to Blot: 232 and lying between the southerly line of Twenty-fourth Street and the southerly line -of Twenty-fifth Street, all according to the Map of National City No. 348 filed in the office of the Recorder of the County of San Diego, .State of California, October 2, 1882. (Reserving therefrom the easterly fourteen feet of Cleveland Avenue (formerly Eighth Avenue) adjacent to the westerly line of vacated forty foot Cleveland Avenue and between the southerly line of Twenty-fourth Street and the southerly line of Twenty-fifth Street as shown on said Map 348.) Time for hearing any and all persons interested in or objecting to the proposed vacation is hereby set for 7:45 p.m., September 10, 1974, in the City Council Chambers in the Civic Center in the City of National City, California. The City Engineer of the City of National City, California, is hereby directed to post notice of the passage of this Resolution and the time and place of hear- ing in accordance with law. PASSED AND ADOPTED this 6th day of August, 1974. ATTEST: ORDER OF VACATION 25th Street between the Westerly line of Cleveland Avenue to the Easterly line of Harrison Avenue, and Cleveland Avenue from the Southerly line of 24th Street to the Southerly line of 25th Street The City of National City, by authority of Resolution No. 12,268 duly adopted on February 22, 1977, by the City Council of the City of National City, hereby orders the vacation of the following street within the City limits of National City: All that portion of Twenty-fifth Street adjacent to Block 281 and 282 lying between the easterly line of Harrison Avenue (formerly Ninth Avenue) and the westerly line of Cleveland Avenue (form- erly Eighth Avenue) adjacent to Block 281 and vacated forty foot street adjacent to Block 232 and lying between the southerly line of Twenty- fourth Street and the southerly line of Twenty- fifth Street, all according to the Map of National City No. 348 filed in the office of the Recorder of the County of San Diego, State of California, October 2, 1882.
