RESOLUTION GRANTING ZONE VARIANCE PURSUANT TO
THE LAND USE CODE OF THE CITY OF NATIONAL CITY
(Z-2-77, to allow a theatrical studio and theatre
offering live performances with less than the required
amount of off-street parking at 500 East Plaza Boulevard
Lamb's Players, Inc.)
The City Council of the City of National City
does hereby find, determine, order and resolve as follows:
1. That practical difficulties, unnecessary
hardship, and a result inconsistent with the general purpose
and intent of the Land Use Code of the City of National
City would occur through strict application of the pro-
visions of said Code to that certain real property here-
inafter described.
2. That a Petition requesting a variance has
been filed pursuant to the provisions of the Land Use
Code and said petition complies with all the requirements
of said Code.
3. That the National City Planning Commission
did hold a hearing on said Petition and did recommend to
the City Council that a variance be granted.
4. That the granting of a variance with refer-
ence to the property hereinafter described will not defeat,
but rather will carry out the general intent and purpose
of the National City Land Use Code, will provide for the
public safety and welfare and will administer substantial
justice.
5. That a variance from the provisions of said
Land Use Code be and hereby is granted with reference to
all the certain real property situated in the City of
National City, California, more particularly described as
follows:
ASSESSORS PARCEL NO. 556-570-01:
All that portion of the Easterly Half of the
Westerly Half of 10 Acres Lot 14, Quarter
Section 154, Rancho de la Nacion, in the City
of National City, County of San Diego, State
of California, according to the Map thereof
No. 166, made by Morrill, on file in the
Office of the County Recorder of San Diego
County, described as follows:
BEGINNING. at the Northwesterly corner of said
Easterly Half of the Westerly Half of said
10 Acres Lot 14; thence along the Northerly
line of said Lot North 71°00'00" East, 90.00
feet; thence South 19°00'00" East 165.00 feet;
thence South 71°00'00" West, 90.00 feet to
the Westerly line of said Easterly Half of
the Westerly Half of said Lot; thence along
said Westerly line North 19°00'00" West 165.00
feet to the Point of Beginning.
EXCEPTING therefrom the North 40.00 feet
as conveyed to the City of National City in
deed recorded August 21,.1909 in Book 467,
Page 292 of Deeds for street purposes.
ALSO -EXCEPTING therefrom the West 15.00
feet as conveyed to the City of National City
in deed recorded December 20, 1949 in Book
3427, Page 198 of Official Records.
6. That the variance hereby granted is as
follows: To allow a theatrical studio and theatre
offering live performances with less than the required
amount of off-street parking at 500 East Plaza Boulevard,
subject to the following conditions:
a. This variance shall not become effective
until the applicant files with the Planning Department a
written statement acknowledging and accepting all conditions
as hereinbelow set forth. Failure to file said statement
within 30 days of Planning Commission hearing on the
variance shall automatically terminate the variance.
b. Seating shall be limited to 144 and
a maximum 55 employees. Commercial vehicles used in
connection with the operation of the premises shall not
exceed 6.
c. Parking and street sweeping shall be
subject to review by the Police Department and Public
Works Department, respectively, and a time limit on
the parking, day and night, be imposed, if necessary.
d. Approval of this variance carries the
stipulation the approval is precisely limited to the
activities described in the application on file.
