HomeMy WebLinkAboutCC RESO 12,043RESOLUTION NO. 12,043 RESOLUTION GRANTING ZONE VARIANCE PURSUANT TO THE LAND USE CODE OF THE CITY OF NATIONAL CITY (Z-4-76, to allow construction of a view -obscuring fence on property line at the southeast corner of 20th Street and Cleveland Avenue [Pepper Industries, Inc.]) The City Council of the City of National City does hereby find, determine, order and resolve as follows: 1. That practical difficulties, unnecessary hardship, and a result inconsistent with the general purpose and intent of the Land Use Code of the City of National City would occur through strict application of the pro- visions of said Code to that certain real property hereinafter described. 2. That a Petition requesting a variance has been filed pursuant to the provisions of the Land Use Code and said petitioncomplies with all the requirements of said Code. 3. That the National City Planning Commission did hold a hearing on said Petition and did recommend to the City Council that a variance be granted. 4. That the granting of a variance with refer- ence to the property hereinafter described will not defeat, but rather will carry out the general intent and purpose of the National City Land Use Code, will provide for the public safety and welfare and will administer substantial justice. 5. That a variance from the provisions of said Land Use Code be and hereby is granted with reference to all the certain real property situated in the City of National City, California, more particularly described as follows: Lots 1, 2, 3, and 4, and vacated alley adjacent, Block 236 of National City according to the Map No. 348 filed with the County Recorder in 1882. 6. That the variance hereby granted is as follows: To allow construction of a view -obscuring fence on property at the southeast corner of 20th Street and Cleveland Avenue, subject to the condition that adjoining parkways on 20th and on Cleveland shall be landscaped in accordance with the provisions of Chapter 13.18 of Title 13, Municipal Code.
