HomeMy WebLinkAboutCC RESO 12,060RESOLUTION NO. 12,060 RESOLUTION ACCEPTING COVENANT RUNNING WITH THE LAND AND DIRECTING THE RECORDING THEREOF (Raul Murrillo Torres & Conception R. de Torres) BE IT RESOLVED by the City Council of the City of National City that a Covenant granted to the City of National City by Raul Murrillo Torres & Conception R. de Torres affecting property at 2009 "D" Avenue is hereby accepted and the City Clerk is directed to record the same. PASSED AND ADOPTED this 15th day of June, 1976. ATTEST: After recording, return to: CITY CLERK OF NATIONAL CITY 1243 National Avenue National City, Ca. 92050 COVENANT RUNNING WITH THE LAND This COVENANT is made by Raul Murrillo Torres & Concepcion R. de Torres hereinafter referred to as "OWNER". WHEREAS Raul Murrillo Torres & Concepcion R. de Torres is the owner of that certain real property located in the City of National City, County of San E',go, State of California, described as follows: :s 1 and 2 of Steins Subdivision per Map 1517 in the City of National City, County of i Diego, State of California, filed in the Office of the County Recorder of said San .go County, January 14, 1913. WHEREAS, said owner desires to be excused from the legal requirement to install the following improvements: 1. Remove 25 Square feet of sidewalk (on 20th St. at "D" Avenue) 2. Construct 25 square feet of sidewalk (on 20th St. at "D" Avenue) 3. Excavate 24.24 cubic yards and sawcut as required (alley 20th to 21st St. between "D" and "E" Avenues. 4. Construct 350 square feet of 6" deep crusher run base material (above alley) 5. Construct 350 square feet of 2" asphalt concrete pavement (above alley) 6. Construct 300 square feet of "6" Portland Cement concrete (above alley) /sidewalk on 20th St. at "D" Ave. & alley 20th to 21st between "D" & "E" Avenues for ; NOW, THEREFORE, in consid- eration for the granting of a deferral to install said improvements by the City Council of the City of National City, said owner covenants for themselves and their heirs, successors, assigns, executors and administrators as follows: 1. The owner will not protest the installation of any of the required improvements under a 1911 Improvement Act program whether initiated by the property owners or the City. 2. The owner will install said improvements in conjunction with an overall improvement pz iram of the areawhether. initiated by the property owners or the City. 3. The owner will install said improvements within thirty (30) days of demand. 4. The owner grants to the City a lien upon his property in the amount of 51,025.00 ($ 1,025.00 ) reasonable attorneys fees to assure the installation of such improvements on or before the llthday of May 19 81 5.
