A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL
CITY, CALIFORNIA, ANNOUNCING ITS INTENTION TO DISPOSE OF
CERTAIN REAL PROPERTY AND MAKING RELATED FINDINGS
(NORTHEAST CORNER OF SWEETWATER ROAD AND GROVE STREET)
WHEREAS, the realignment of Grove Street at Sweet-
water Road in 1971, isolated a small residual parcel within
the boundaries of Las Palmas Park as shown on Exhibit "A"
attached hereto, and
WHEREAS, it has been demonstrated that these con-
ditions exist:
1. The City Council established all of Las Palmas
Park as a public park with adoption of their Resolution
No. 8198 on October 2, 1962.
2. Because of an existing unimproved drainage
ditch occupying nearly all of this parcel, it has never
been used for public park purposes.
3. Because this parcel is now isolated from the
rest of Las Palmas Park by the presence of Grove Street,
a public street, it no longer bears any present or
future useful relationship to the park. It is no
longer appropriate, convenient or necessary for park
purposes.
4. This Park was not purchased with funds realized
from the sale of bonds of a bond issue authorized for
the purpose of acquiring land for park purposes. No
consideration has been paid for the land except by the
City, no public funds have been expended to improve the
land as a park and the land is not appropriate, conven-
ient or necessary for park purposes.
5. The parcel, containing less than the required
minimum lot area and containing a drainage ditch and
sewer line within easements over its entire length
and most of its width is not useable as a building site.
WHEREAS, the adjoining property owner has expressed
an interest in purchasing the land described in Exhibit "A"
to add to a building project he is proposing on said adjoin-
ing property, and
WHEREAS, the sale of this property to the adjoining
property owner will be in the public interest because the prop-
erty owner will have a more pleasing development if his park-
ing could encroach upon this land and if the balance could be
improved with a drain pipe, fill, and landscaping to standards
established by the City; sale of the property to the adjoining
property owner, who would be the only purchaser with a signi-
ficant economic interest, would put it on the tax rolls; land-
scaping of the property would provide a more pleasing access
to Las Palmas Park at no cost to the City; and the drain pipe
would be installed by a private individual, at his expense,
which would avoid the necessity of such work by the City at
a later date, and
WHEREAS, the adjoining property owner has indicated
willingness to negotiate with the City for an equitable pur-
chase price, part of which may be the installation of street
improvements, landscaping and storm drains at no cost to the
City except the cost of drainage pipe materials, and
WHEREAS, the City Manager has been advised by
written opinion of the City Attorney dated July 22, 1974 that
the action intended herein is legally appropriate;
NOW, THEREFORE, BE IT RESOLVED, that this City
Council announces its intention to negotiate terms and con-
ditions of sale and to sell that land described in Exhibit
"A" to the adjoining property owner. Said terms and conditions
shall require no less than:
1. Property owner shall provide, to City Standards,
sidewalks along all street frontages.
2. Property owner shall cause to be installed the
storm drain pipe furnished by the City.
3. Property owner shall install landscaping with
irrigation on all parts of this parcel not used for
his parking facilities.
4. Property owner shall place approved fill
material necessary to restore the parcel to accept-
able grades and elevations.
5. Property owner shall grant easements or
accept the reservation of easements by City, for
sewers and storm drains including access thereto and
for the placement by City of signs identifying this
entrance to the City Limits of National City and/or
Las Palmas Park.
6. Property owner shall post a suitable bond
or surety with the City guaranteeing the completion
of all the above work within a period of 12 months
following the adoption of this Resolution, and
BE IT FURTHER RESOLVED that this City Council
will meet on August 17, 1976 to take final action on this
intended action, at which time any person may appear and
state his objection. thereto.
BE IT FURTHER RESOLVED that this Resolution is
to be published pursuant to Government Code Section 6063
in a newspaper of general circulation published in the
City, if there is one, or in a newspaper designated by the
City Council which is published in the County. At least
four (4) copies of the Resolution shall be posted conspic-
uously not more than 100 feet apart along the boundaries
of the park.
