A RESOLUTION OF THE CITY OF NATIONAL CITY
AUTHORIZING THE MAYOR TO EXECUTE A RELEASE
OF TERMS AND CONDITIONS AND DIRECTING THE
RECORDATION THEREOF
(30th Street and "A" Avenue)
WHEREAS, pursuant to that certain bid for the
sale of City owned property dated January 14, 1975, PKM,
A Partnership, purchased certain City owned property
located at the northeast corner of 30th Street and "A"
Avenue in National City, and
WHEREAS, said bid identified certain occupants
of the proposed development together with a preliminary
structural design and proposed development costs, and
WHEREAS, the sale of said property under date
of March 11, 1975 recorded in the Office of the County
Recorder, San Diego County, as file document No. 75-054059
imposed certain terms and conditions on the purchase, and
WHEREAS, a change in the structural composition
of the partnership (buyer),has resulted in certain proposed
modifications to the building design and occupants, and
WHEREAS, in order to facilitate financing of
the proposed development and clear title to the property,
the buyer is requesting a Release of said Terms and Con-
ditions;
NOW, THEREFORE, BE IT RESOLVED as follows:
SECTION 1. The Mayor is hereby authorized
to execute a Release of Terms and Conditions as contained
in Exhibit "B" of the Corporation Grant Deed to PKM, A
Partnership, dated March 11, 1975 and recorded as file/
page No. 75-054059.
SECTION 2. The City Clerk is hereby authorized
and directed to record said release with the Office of
the Recorder of San Diego County.

RELEASE OF TERMS AND CONDITIONS
NOTICE IS HEREBY GIVEN by the City of National City pursuant
to Resolution No. 12,011 dated April 6, 1976 that all terms
and conditions contained in that certain Corporation Grant
Deed from the City of National City to PKM, A Partnership,
dated March 11, 1975 and recorded in the office of -the
County Recorder, County of San Diego, March 11, 1975 as
file/page Document No. 75-054059 pertaining to that
certain real property situated in the City of National
City, County of San Diego, and more particularly described
on the attached Exhibit 'A' ARE HEREBY RELEASED.

City; thence'Northerly along said Easterly line of National Avenue to
the point of tangency of a 36.00 foot radius circular arc, concave
Northeasterly, which is tangent to the. Easterly. line of National Avenue.

Section II. Commence Construction
The Grantee shall within thirty (30) days after the issuance
of all permits required by the Department of Building and Housing

Section III. Complete Construction
The Grantee shall-w**AMOMILS hundred and fifty (150) days
after construction cormepursuant to Section II above,
complete construction of said proposed improvements.
Section IV. Time Extensions
The time periods identified in Sections I, II and III above
may be extended by action of the City Council of the City of
National City at its sole discretion. Reasons for s>Sch extensions
would be inclement weather, strikes, acts of God, etc. Failure
to commence or diligently prosecute construction of said proposed
improvements shall be considered a material breech of these terms
and conditions. Time extensions granted by the City Council
pursuant to this section shall be made a public record by the
recording of a "Notice of Time Extension" in the Office of the
County Recorder. -

Section V. Release of Terms and Conditions
Upon the fulfillment of all terms and conditions as set
forth herein the City shall record in the Office of the County
Recorder of San Diego County a "Release of Terms and Conditions"
in order to clear title to the property.
