HomeMy WebLinkAboutCC RESO 12,020RESOLUTION NO. 12,020 RESOLUTION GRANTING ZONE VARIANCE PURSUANT TO ORDINANCE NO. 962 (Z-2-76, to allow construction of an on -site identifica- tion structure in excess of fifty feet (50') in height at South Bay Town.& Country Shopping Center, South side of Sweetwater Road between Edgemere Avenue and Interstate 805 [George A. Pflaum] The City Council of the City of National City does hereby find, determine, order and resolve ""follows: 1. That practical difficulties, unnecessary hardship, and a result inconsistent with the general purpose and intent of Ordinance No. 962 would occur through strict application of the provisions of said Ordinance to that certain real property hereinafter described. 2. That a Petition requesting a variance has been filed pursuant to the provisions of Section 12 of Ordinance No. 962 and said petition complies with all the requirements of said section. 3. That the National City Planning Commission did hold a hearing on said Petition and did recommend to the City Council that a variance be granted. 4. That the granting of a variance with reference to the property hereinafter described will not defeat, but rather will carry out the general intent and purpose of the National City Zoning Ordinance, will provide for the public safety and welfare and will administer substantial justice. 5. That a variance from the provisions of said Ordinance No. 962 be and hereby is granted with reference to all the certain real property situated in the City of National City, California, more particularly described as follows: All that real property in the City of National City, County of San Diego, State of California, more particularly described as follows: Those portions of Quarter Sections 126, 127, 134 and 135 of Rancho De La Nation, according to map thereof No. 166 by Morrill, filed in the office of the County Recorder of said County, together with those portions of Lots 187 through 197 of Lincoln Acres Annex, according to Map thereof No. 1745, filed in the office of the County Recorder of said County, January 3, 1923, and those portions of Lincoln Acres, according to Map No. 1740, filed in the office of the County Recorder of said County; included within the following described boundary: Beginning at the Northwest corner of Quarter Section 126; thence along the Northerly line of said Quarter Section, North 72°07'56" East, 243.50 feet (Record 244.52 feet); thence South 48°55'33" East, 209.58 feet to the TRUE POINT OF BEGINNING; thence South 79°21'42" East, 781.82 feet; thence South 81°09'17" East, 223.73 feet to a tangent 225.00 foot radius curve concave Northerly; thence Easterly along said curve through a central angle of 39°40'21" a distance of 155.79 feet to the beginning of a 100 foot radius compound curve, Northeasterly and Northerly along said curve through a central angle of 117°13'50" a distance of 204.61 feet; thence tangent to said curve, North 58°13'38" West, 176.15 feet to the beginning of a 350 foot radius curve, Northerly along said curve through a central angle of 36°23'49" a distance of 222.34 feet; thence tangent to said curve, North 22°06'31" West, 282.67 feet; thence North 71°15'46" West, 105.74 feet; thence North 69°22'14" West, 209.66 feet; thence North 78°34'34" West 208.58 feet to the beginning of a 957 foot radius curve, thence Westerly along said curve through a central angle of 23°51'16" a distance of 398.44 feet; thence tangent to said curve, South 77°33'33" West, 74.18 feet; thence along the arc of a curve, concave Northerly, through a central angle of 3°02'38", having a radius of 598.69 feet, a distance of 31.81 feet; thence leaving said curve South 77°33'33" West, 451.31 feet; thence South 80°30'O1" West, 116.19 feet; thence South 29°09'23" East, 1.32 feet; thence South 77°37'33" West, 78.69 feet; thence South 29°09'23" East, 0.35 feet; thence along the arc of a 40 foot radius curve, concave Southeasterly, a distance of 69.20 feet through a central angle of 99°07'03"; thence tangent to said curve, South 29°09'23" East, 238.17 feet; thence South 80°30'01" West, 25.37 feet; thence South 29°09'23" East, 110.01 feet; thence South 32°56'20" East, 30.44 feet; thence North 60°50'37" East, 192.89 feet; thence South 29°09'23" East, 180.00 feet; thence South 60°50'37" West, 127.77 feet; thence North 82°33'20" East, 185.00 feet to a tangent 1700.00 foot radius curve, concave Southerly, thence Easterly along the arc of said curve through a central angle of 13°10'57" a distance of 391.13 feet; thence tangent to said curve, South 79°21'42" East, 27.26 feet to the TRUE POINT OF BEGINNING. 6. That the variance hereby granted is as follows: To allow construction of an on -site identification structure in excess of fifty feet (50') in height at South Bay Town & Country Shopping Center, South side of Sweetwater Road between Edgemere Avenue and Interstate 805, subject to the following conditions: a. Development shall be in conformity with drawing prepared by California Neon Products, Drawing No. 6924-R1, dated February 19, 1976; and, City of National City Planning Department Drawing for Case File No. Z-2-76, dated February 24, 1976. b. That the sign be limited to advertising "South Bay Town & Country," "The Grove," or other collective name for the proposed group of restaurants, the name of each restaurant, and no other advertising copy for other uses within the center.
