HomeMy WebLinkAboutCC RESO 12,198RESOLUTION NO. 12,198 A RESOLUTION OF THE CITY OF NATIONAL CITY AUTHORIZING CONVEYANCE OF CERTAIN CITY OWNED REAL PROPERTY (W. G. & Assoc., Ltd., Northeast Corner of Sweetwater Road and Grove Avenue) WHEREAS, the City is the owner of that certain real property located at the Northeast corner of Sweetwater Road and Grove Avenue, more particularly described on the attached Exhibit 'A' incorporated and made a part hereof, and WHEREAS, said property was formerly included within the boundary of Las Palmas Park and is now considered excess City property, and WHEREAS, on August 17, 1976 the City Council held a public hearing to consider the disposition of this property, and WHEREAS, on August 17, 1976 the City Council adopted Resolution 12,092, and WHEREAS, the owner of real property adjoining the subject property on the east, W. G. and Associates, Ltd., herein referred to as "buyer" has offered to purchase said property, and WHEREAS, consideration for said purchase shall be the cost of certain public improvements by the buyer, including a storm drainage facility located on the property, and WHEREAS, the cost of these improvements has been estimated by the City Engineer at $15,300, which amount exceeds the value of the property, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of National City as follows: Section 1. The Mayor is hereby authorized to execute on behalf of the City an appropriate in- strument conveying said property subject to the buyer executing a performance agreement and filing a performance bond with the City covering the estimated cost of the improve- ments guaranteeing the installation of said improvements. ATTEST: Section 2. The City Engineer is hereby authorized to execute said performance agreement guaranteeing improvement installation and to accept an appropriate surety bond. Section 3. Said conveyance shall reserve all necessary easements and rights -of -way to the City. PASSED AND ADOPTED, this 7th day of December, 1976. CITY CLE
