RESOLUTION AUTHORIZING EXECUTION OF AGREEMENT
BETWEEN CITY OF NATIONAL CITY AND COUNTY OF
SAN DIEGO FOR THE USE OF REVENUE SHARING FUNDS
FOR THE REDEVELOPMENT OF LAS PALMAS PARK
BE IT RESOLVED by the City Council of the
City of National City that the Mayor is hereby authorized
and directed to execute, and the City Clerk is authorized
to attest, an agreement between the City of National City
and the County of San Diego for the use of revenue sharing
funds for the redevelopment of Las Palmas Park.

THIS AGREEMENT executed'this •day of
1975, by 'and between the CITY OF NATIONAL CITY, municipal cor-
poration, hereinafter called the City, and the COUNTY OF SAN
DIEGO, political subdivision of the State of California, herein-
after called the County.
WITNESSETH:
WHEREAS, on April 15, 1975, the County Board of
Supervisors approved the expenditure of One Hundred Seventy
Thousand Dollars ($170,000.00)•in General Revenue Sharing
Funds for development of Las Palmas Park in National City
and requested the City to prepare a development plan for
. general recreational facilities, such plan to be submitted
for review and concurrence prior to expenditure of funds;
and
WHEREAS, the City of National City has adopted Resolu-
tion No. 11,726 requesting appropriation of $170,000.00 of budgeted
county funds in order to provide improved park facilities in Las
Palmas Park for Lincoln Acres residents;
NOW, THEREFORE, IT IS MUTUALLY AGREED by and between.
the City and County as follows:
1. This agreement shall be administered on behalf of
the County by the Director of Parks and Recreation.
2. a. A development plan and detailed cost estimate
shall be submitted to the County by the City for review and
concurrence by the Director of Parks and Recreation before
funds are released for expenditure. For work to be done by
contract, plans and specifications of the type normally required
for contract work shall be submitted. For force account work,
a plan of the type normally required for such work with des-
cription of materials and construction sufficient to enable
adequate review of the proposed work shall be submitted.
b. County will concur in writing to said plans.
Upon concurrence, funds allocated for this project shall be en-
cumbered by the County for the period specified in Section 2
hereof and shall not be used for any other purpose other than
this project without the expressed authorization of the City
of National City.
3. Development shall be completed within one year
from the beginning of construction, unless an extension of
time is agreed to by both parties. The County Director' of
Parks and Recreation is delegated authority to act for the
Board of Supervisors in approving such an extension.
a. Costs for all design, including but not limited
to engineering and architectural fees, environmental reports,
construction, equipment and installation of all improvements
provided by the terms of this agreement in an amount not to
exceed $170,000.00 shall be borne.by the County of San Diego.
b. Payment shall be made for all costs, equipment,
materials and contracts by the County of San Diego upon demand
by the City of National City based on actual receipts, contract-
ors' invoices or documentation of force account work furnished
by the City.
4. The City shall be responsible for obtaining re-
quired clearances and approvals on matters such as environmental
impact reports and Coastal Commission requirements.
5. The City shall be responsible for maintenance of
the park in perpetuity, (for City and County unincorporated area
residents alike) as well as being responsible for development of
the park.
6. Facilities provided with County funds shall not be
terminated or substantially changed in the future without the
agreement and approval of the County Board of Supervisors.

7. The City will hold the County harmless from any
actions resulting from the park construction and development.
IN WITNESS WHEREOF this Agreement is executed by the
County of.San Diego by action taken by its Board of Supervisors
and by the City of National City by action taken by the City
Council.
