HomeMy WebLinkAboutCC RESO 11,827RESOLUTION NO. 11,827 RESOLUTION AUTHORIZING EXECUTION OF AGREEMENT BETWEEN CITY OF NATIONAL CITY AND CITY OF TECATE, BAJA CALIFORNIA, MEXICO, PROVIDING FOR THE DISMANTLEMENT OF NATIONAL CITY'S OLD PUBLIC WORKS BUILDING BE IT RESOLVED by the City Council of the City of National City that the Mayor is hereby authorized and directed to execute that certain AGREEMENT BETWEEN CITY OF NATIONAL CITY AND CITY OF TECATE, BAJA CALIFORNIA, MEXICO, providing for the Dismantlement of National City's Old Public Works Building. PASSED AND ADOPTED this 5th day of August, 1975. ATTEST: AGREEMENT between CITY OF NATIONAL CITY and CITY OF TECATE, BAJA CALIFORNIA, MEXICO Providing for the Dismantlement of National City's Old Public Works Building WHEREAS, the City of National City is the: owner of the steel frame structure which it formerly used as its Public Works Building, and WHEREAS, the City of Tecate is desirous of using said structure as its Public Works Building, and WHEREAS, the City of National City and the City of Tecate are Sister Cities and have maintained friendly relations, and WHEREAS, the City of National City is desirous of continuing said friendly relationship, the City of National City and the City of Tecate hereby agree as follows: 1. The City of National City is the owner of steel frame improvements located at 2105 Hoover Avenue, National City. 2. The City of Tecate agrees to dismantle and re- move from the project area all improvements. Said removal is to commence on or after August 9, 1975 or before September 15, 1975. 3. Before commencement of removal of improvements, City of Tecate will assure the disconnection and/or capping of all utilities on the premises and will comply with all codes, regulations, or general practices as required by the City of National City and/or the utility company concerned. In the event any utility service lines in use are impaired in any way by reason of the removal of said improvements, City of and must be complete on Tecate will have said lines repaired or replaced at its ex- pense. 4. City of Tecate will remove said improvements in a careful and workmanlike manner and will eliminate all conditions that might constitute attractive nuisances or hazardous conditions for the general public. All combustible materials and rubbish will be removed, leaving onlyconcrete foundations and concrete flatwork on the premises. All mud - sill and protruding iron or bolts, pipes, and conduits, earth shall be bent over or steel, such as reinforcing steel, embedded in exposed concrete or sheared at all exposed surfaces. Sewer lines will be capped in a permanent manner and approved by the National City Department of Building and Housing. 5. City of Tecate shall indemnify and save harm- less the City of National City, its officers, agents, and employees against all any injury to persons reason of the removal loss, cost, or damage on account of or damage to property occurring by of said improvements. City of Tecate assumes all risk and responsibility in removing said improve- ments including any loss by reason of vandalism. DATED this 5th day of August, 1975.
