HomeMy WebLinkAboutCC RESO 11,829RESOLUTION NO. 11,829 RESOLUTION GRANTING ZONE VARIANCE PURSUANT TO ORDINANCE NO. 962 (Z-7-75, from setback and landscaping requirements, 3000 National Avenue (Parcel No. 562-220-13 and portion of Parcel No. 562-240-01 - Castle A.M.C.) The City Council of the City of National City does hereby find, determine, order and resolve as follows: 1. That practical difficulties, unnecessary hardship, and a result inconsistent with the general purpose and intent of Ordinance No. 962 would occur through strict application of the provisions of said Ordinance to that certain real property hereinafter described. 2. That a Petition requesting a variance has been filed pursuant to the provisions of Section 12 of Ordinance No. 962 and said Petition complies with all the requirements of said section. 3. That the National City Planning Commission did hold a hearing on said Petition and did recommend to the City Council that a variance be granted. 4. That the granting of a variance with reference to the property hereinafter described will not defeat, but rather will carry out the general intent and purpose of the National City Zoning Ordinance, will provide for the public safety and welfare and will administer substantial justice. 5. That a variance from the provisions of said Ordinance No. 962 be and hereby is granted with reference to all the certain real property situated in the City of National City, California, more particularly described as follows: All that portion of Bahia Vista, according to the Map thereof Number 1815 in the City of National City, County of San Diego, State of California described as follows: Beginning at the Northwesterly corner of Lot 143; thence South 18°35' East a distance of 230 feet to the Southwesterly corner of Lot 140; thence North 71°25' East, 150 feet to a point on the Westerly line of Lot 167; thence South 18°35' East, 155.12 feet to the Southwesterly corner of Lot 173; thence Easterly along the Southerly line of Lot 173 a distance of 140 feet to the Southeasterly corner of said Lot 173, said point being also on the Westerly line of National Avenue thence North 18°35' West along the Westerly line of said National Avenue a distance of 349.12 feet more or less to a point 0.88 feet Southerly of the Southeasterly corner of Lot 161; thence leaving said Westerly line of National Avenue, along the arc of a 36 foot radius curve, concave to the Southwesterly, said curve being 56.55 feet in length, to a point of intersection on the Northerly line of Lot 161; thence South 71°25' West, 254 feet to the point of beginning. 6. That the variance hereby granted is as follows: From setback and landscape requirements at 3000 National Avenue, subject to five conditions as follows: a. Property owner to record a covenant with the San Diego County Assessor's office, agreeing to hold property (site of Castle A.M.C.) as one parcel. b. Tree wells shall be approved as to location and size; and, trees shall be approved as to type, size and specie, by the Planning Department prior to installation. c. Above conditions shall be satisfied within a period of time not to exceed (60) days from date of City Council adoption of Resolution granting variance. d. The variance be granted upon the condition that when future improvements are made on the site of Castle A.M.C., that meet or exceed a Building Department valuation of $16,000.00, all blacktop surfacing shall be removed from the parkway on National Avenue and turf shall be planted and a peimanent underground irrigation system shall be provided. e. Prior to City Council adoption of Resolution granting variance, the property owner shall file with the Planning Department an acknowledgment in writing stating that he is cognizant of all conditions as hereinabove set forth and agrees to satisfy same within the time period specified. PASSED AND ADOPTED this l2th day of August, 1975. ATTEST:
