RESOLUTION GRANTING ZONE VARIANCE PURSUANT TO
ORDINANCE NO. 962
(Z-11-75, to reduce the required 25' rear yard setback
to 12' and denial of zone variance to reduce the required
4' interior side yard setback to 1-1/2' at 225 Mann Avenue)
The City Council of the City of National City
does hereby find, determine, order and resolve as follows:
1. That practical difficulties, unnecessary
hardship, and a result inconsistent with the general purpose
and intent of Ordinance No. 962 would occur through strict
application of the provisions of said Ordinance to that
certain real property hereinafter described.
2. That a Petition requesting a variance has
been filed pursuant to the provisions of Section 12 of
Ordinance No. 962 and said petition complies with all the
requirements of said section.
3. That the National City Planning Commission
did hold a hearing on said petition and did recommend to
the City Council that the variance described below be granted
and that the zone variance to reduce the required 4' interior
side yard setback to 1-1/2' be denied.
4. That the granting of a variance with reference
to the property hereinafter described will not defeat, but
rather will carry out the general intent and purpose of the
National City Zoning Ordinance, will provide for the public
safety and welfare and will administer substantial justice.
5. That a variance from the provisions of said
Ordinance No. 962 be and hereby is granted with reference
to all the certain real property situated in the City of
National City, California, more particularly described as
follows:

Lot #21 of Hilltop Park Subdivision, accord-
ing to map thereof No. 2766, filed in the
office of the County Recorder of San Diego
County.
6. That the variance hereby granted is as follows:
To reduce the required 25' rear yard setback to 12', subject
to the following conditions:
a. Property owner shall make application and
obtain required permit for the proposed addition from the
Department of Building and Housing.
b. In accordance with Section 104(c) of the
Uniform Building Code the proposed addition shall meet all
the requirements for a new building.
c. Those parts of the foundation of the exist-
ing residence used to support the second story addition shall
be investigated by a State of California registered civil
or structural engineer. Results of such investigation shall
be submitted to the Department of Building and Housing for
approval at such time as application is made for building
permit.
