HomeMy WebLinkAboutCC RESO 11,916RESOLUTION NO. 11,916 RESOLUTION GRANTING CONDITIONAL USE PERMIT NO. 1975-14 TO ALLOW CONVERSION OF A DUPLEX AT 826- 828 EAST TWENTY-SECOND STREET, FROM RESIDENTIAL USE TO NURSERY SCHOOL CLASSROOMS, TO BE USED IN CONJUNCTION WITH THE. EXISTING LAD 'N LASSIE NURSERY SCHOOL LOCATED AT THE SOUTHEAST CORNER OF TWENTY-SECOND STREET AND HIGHLAND AVENUE (Dallis Widick) The City Council of the City of National City does hereby find, determine, order and resolve as follows: 1. At a regular meeting of the City Planning Commission on October 13, 1975, said Commission unanimously adopted a recommendation that the owners of the real property located at 826-828 East Twenty-second Street, be granted a Conditional Use Permit upon the conditions here- inafter stated. 2. That the City Council has received the recommendation of the Planning Commission, and after full and complete consideration of said recommendation hereby grants a Conditional Use Permit No. 1975-14 for conversion of a duplex at 826-828 East Twenty-second Street, from residential use to nursery school classrooms, to be used in conjunction with the existing Lad 'N Lassie Nursery School located at the southeast corner of Twenty-second Street and Highland Avenue, subject to the following terms and conditions: a. Prior to the Issuance of a building permit the applicant shall file with the Planning Depart- ment an acknowledgment in writing stating that he is cognizant of all conditions as hereinbelow set forth and agrees to accomplish same within a time period not to exceed 120 days from date of City Council adoption of resolution granting conditional Use Permit. b. Prior to the issuance of a Certificate of Occupancy by the Building Department, the following shall have been satisfied: (1) Installation of sidewalks on 22nd Street frontage of San Diego County Assessor's Parcel No. 561-311-10. (2) Installation of parkway landscape and irrigation on 22nd Street frontage of San Diego County Assessor's Parcel No. 561-311-10 (detailed landscape/irri- gation plan to be approved by the Planning Department prior to installation). (3) Installation of permanent alley paving where adjacent to San Diego County Assessor's Parcel No. 561-311-10 � �.C.1d �►nn.t�.� (4) One additional off-street parking site (9' x 20' minimum) shall be provided immediately adjacent to existing three (3) spaces at the northeast corner of San Diego County Assessor's Parcel No. 561-311-01. (5) All electrical, telephone and similar distribution service wires to the structure being converted shall be placed underground. (6) Conversion of existing duplex shall be subject to Planning Commission approval of plans. (7) A masonry trash receptacle storage enclosure (with gates) shall be provided adjacent to southerly side of required parking sites on San Diego County Assessor's Parcel No. 561-311-01. (8) The property owner shall record a Covenant and Agreement to Hold Property as One Parcel, (San Diego County Assessor's Parcels Nos. 561-311-01 and 561-311-10). (9) Any room or area to be used that has an occupant load in excess of five (5) or a floor area of more than 250 square feet shall be provided with two exits, exits shall be spaced not less than 50% of the diagonal dimension of the room or area. (10) Building, grounds, and facilities shall be made available and accessible for the physically handicapped. (11) Electric and gas service shall be modified to provide one electric and one gas service for the building. (12) Provide a minimum of one drinking • fountain. (13) Upon submission of remodeling or modification plans specific corrections may be required for compliance with Federal, State or local codes or ordinances.
