RESOLUTION AUTHORIZING EXECUTION OF CORPORATION
GRANT DEED TO P.K.M., A CALIFORNIA PARTNERSHIP
BE IT RESOLVED by the City Council of the City
of National City, California as follows:
That the Mayor and the City Clerk are authorized
and directed to execute and attest that certain Corporation
Grant Deed to P.K.M., a partnership, the property more
fully described in said Corporation Grant Deed, a copy of
which is attached hereto and is hereby incorporated by
reference.

1975.

the following described real property in the State of California, County of San Diego:
Lots 1 through 20 inclusive in Block 2 and the Easterly 10.00
feet of "A" Avenue and the Westerly 40.00 feet of "B" Avenue
closed to the public use in Budd Villa Tract along with the
20 foot Alley in Block 2 closed to the Public per document
dated December 19, 1919, Resolution #574 of the City of
National City recorded February 19, 1975 as file #75-037745;
all being in the City of National City, County of San Diego,
State of California according to Map thereof #1067 filed in
the Office of the Recorder in the County of San Diego, June 19,
1907. Exceptions and reservations are particularly described
on the attached Exhibit "A", made a part hereof.
This Conveyance is subject to the Terms and Conditions as
contained in the attached Exhibit "B" incorporated into and
made a part hereof.

EXCEPTING therefrom those portions dedicated for public street
purposes by document recorded October 27, 1967, as File No.
168030 and 168031 more particularly described as follows:
BEGINNING at the intersection of the Easterly line of National
Avenue with the Northerly line of the Southerly 40.00 feet of
10 Acre Lot 6, Quarter Section 152, as shown on said Map of
Budd Villa Tract, said intersection being also a corner in
the boundary of the City of National City; thence Northerly
along said Easterly line of National Avenue to the point of
tangency of a 36.00 foot radius circular arc, concave North-
easterly, which is tangent to the Easterly line of National
Avenue on the West and tangent on the South to a line parallel
with and 40.00 feet Northwesterly, measured at right angles
to Line "A", as hereinafter described; thence Southerly and
Easterly along said 36.00 foot radius circular arc to the
point of tangency with said parallel line; thence along said
parallel line to its intersection with the Easterly line of
the Westerly Half of said 10 Acre Lot 6, being also the
center line of "B" Avenue as shown on said Map of Budd Villa
Tract; thence Southerly along said Easterly line to its
intersection with the southerly line of said 10 Acre Lot 6,
said point being also a corner in the boundary of the City
of National City; thence Westerly along said Southerly line
to its intersection with the Easterly line of the West Half
of the West Half of said 10 Acre Lot 6, being also along the
boundary of the City of National City; thence Northerly along
said Easterly line and along said boundary 40.00 feet to a
corner in said boundary; thence Westerly along a line parallel
with and 40.00 feet Northerly, measured at right angles to the

boundary of the City of National City to the Easterly line of

BEGINNING at a point on the Easterly line of National
Avenue, distant thereon 80.00 feet Northerly of the

easterly in a straight line to the intersection of the
Southerly line of said 10 Acre Lot 6 with the Easterly
line of the West Half of said 10 Acre Lot 6, said
point of intersection being also the intersection of the
centerline of "B" Avenue with the center line of Thirtieth

ALSO nXCEPTING therefrom that portion of the Easterly 10.00
feet of said "A" Avenue and of Lot 9, Block 2 of said
Budd Villa Tract, lying Southerly and Westerly of a 20.00
foot radius circular arc, concave Northeasterly, which is
tangent to the Easterly line of the Westerly 30.00 feet of
said East Half of the West Half of 10 Acre Lot 6 on the
West and tangent to the Northerly line of Thirtieth Street
on the South.
RESERVING THEREFROM:
An easement for sewer purposes in Lots 5 and 6, Quarter Section
152, Rancho de la Nacion, according to Map thereof No. 166 filed
in the Office of the County Recorder of San Diego County, May 11,
1869, described as follows:

A ten foot wide easement, five foot each side of a line
beginning at a point on the Westerly line of said Lot 6,
five feet Northerly of the Southwesterly corner thereof;
thence Easterly, parallel with the Southerly line of
said Lot 6, 235.64 feet to an angle point; thence along a
line bearing 16°57' left 275.94 feet to an angle point;
thence along a line bearing 32°44' left 143.81 feet to
an angle point; thence along a line bearing 29°57' left
209.17 feet to an angle point.

Exhibit "B"
TERMS AND CONDITIONS
Section I. Building Permits/Reversion
The Grantee shall within sixty (60) calendar days from
FPhrhary, 12,1975 apply to the City of National City, Department
of Building and Housing, for a building permit for construction
of the improvements as proposed pursuant to that certain bid
dated January 14, 1975 on file in the Office of the City Clerk
of the City of National City as Document Number 55,160 which
is by reference incorporated into these Teims and Conditions;
make application to the San Diego Coast Regional Commission
and prepare and furnish all environmental statements and/or
reports as required by applicable state or local law, ordinance
or procedure for the construction of said improvements.
In the event the Grantee does not make application for
the required permits or provide the necessary environmental
or other information as required herein within the period
provided above the property shall revert to the Grantor (City
of National City) and the City shall refund the purchase price
less one (1) percent without interest thereon to the successful
bidder.
Section II. Commence Construction
The Grantee shall within thirty (30) days after the issuance
of all permits required by the Department of Building and Housing
and San Diego Coast Regional Commission, pursuant to Section I
above, commence construction of said proposed improvements.
Section III. Complete Construction
The Grantee shall within one hundred and fifty (150) days
after construction commences, pursuant to Section II above,
complete construction of said proposed improvements.

Section IV. Time Extensions
The time periods identified in Sections I, II and III above
may be extended by action of the City Council of the City of
National City at its sole discretion. Reasons for such extensions
would be inclement weather, strikes, acts of God, etc. Failure
to commence or diligently prosecute construction of said proposed
improvements shall be considered a material breech of these terms
and conditions. Time extensions granted by the City Council
pursuant to this section shall be made a public record by
the recording of a "Notice of Time Extension" in the Office of the
County Recorder.

Section V•. Release of Terms and Conditions
Upon the fulfillment of all terms and conditions as set forth
herein the City shall record in the Office of the County Recorder
of San Diego County a "Release of Terms and Conditions" in order to
clear title to the property.
