RESOLUTION REGARDING PAYMENT OF EXCESS ASSESSMENTS,
PAYMENT OF ASSESSMENTS AGAINST PROPERTY OWNED BY THE
STATE OF CALIFORNIA, MODIFICATION OF WORK, PERIOD FOR
RETIREMENT OF BONDS, MODIFICATION OF BOUNDARIES OF
ASSESSMENT DISTRICT, AND EXTENTION OF TIME
WITHIN WHICH TO SIGN CONTRACT
(loth Street, llth Street, 12th Street, "R" Avenue, Paradise
Drive and Palm Avenue, Assessment District No. 161)
WHEREAS, the City Council of the City of National
City has heretofore adopted Resolution of Intention No. 11,284
as a part of the above entitled assessment district proceed-
ings, and
WHEREAS, the City Council of the City of National
City has heretofore determined to contribute to said assessment
district any and all sums of money necessary to reduce the
total assessment on any parcel to an amount not greater than
one half the fair value of such parcel of real property
subject to said assessment, as provided in the Majority Protest
and Debt Limitation Act of the Streets and Highways Code of the
State of California, and
WHEREAS, there are properties owned by the State of
California within the said assessment district and the City
Council intends to pay any and all assessments against said
properties, and
WHEREAS, the City Council did eliminate portions
of work in said assessment district as originally proposed,
including the elimination of the construction of sidewalks
on the westerly side of "R" Avenue, and the elimination of
street improvements and acquisition of right of way from llth
Street East of "R" Avenue, and
WHEREAS, the City Council determined that no modifica-
tion of plans or maps of boundaries of the district were
necessary, since the deletion of work did not increase the
assessments against any property, and all properties within the
district continue to receivesome benefits from the improvements
as the same will be constructed, and
WHEREAS, the bonds for said improvement district are
to be retired over a ten year period as the same is described in
the Resolution of Intention No. 11,284, and
WHEREAS, the Notice of the Adoption of Resolution of
Intention No. 11,284 was published and mailed to all property
owners within the district, and
WHEREAS, the City Council desires to extend the
time within which the work as heretofore ordered and awarded
to construct the work of improvement provided for in these
proceedings;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of National City that:
1. The City of National City will contribute to
said assessment district a sum of money sufficient in amount so
that the assessment against any parcel of land within the district
will not exceed one half the fair value of said parcel of land.
2. The City of National City will pay any and all
assessments in these proceedings levied against property owned
by the State of California.
3. The modifications of work heretofore approved by
the City Council are approved and ratified; and the deletion of
the construction of sidewalks from the Westerly side of "R"
Avenue is approved and ratified; and the deletion of all street
improvements and acquisitions of right of way from llth Street
east of "R" Avenue is approved and ratified.
4. The work,as heretofore ordered and awarded in
these proceedings, reflects the foregoing modifications of
work, and said work;, as ordered and awarded, ,is hereby ratified
and approved.
5. The City Council finds and determinesthat all
properties lying within the assessment district as the same are
described on the boundary maps on file, will benefit from the
construction of the work (as modified) as ordered and awarded.
6. The terms and conditions for the payment of bonds
in these proceedings shall be the same as set forth in the ap-
propriate sections of Resolution of Intention No. 11,284, to wit:
10 years.
7. The time within which the contractor must execute
the..contract to construct the work, as ordered and awarded,
is hereby extended to 30 calendar days from the date of
adoption hereof.
8. The publication of the Notice of the Adoption of
the Resolution of Intention No. 11,284, in lieu of the publica-
tion of the Resolution of Intention itself, is hereby ratified
and approved.
9. The City Council finds and determines that it
has jurisdiction to proceed further this assessment proceeding:.
