HomeMy WebLinkAboutCC RESO 11,570RESOLUTION NO. 11,570 RESOLUTION AUTHORIZING EXECUTION OF AMENDMENT TO AGREEMENT BETWEEN CITY OF NATIONAL CITY AND STATE OF CALIFORNIA DEPARTMENT OF TRANSPORTATION BE IT RESOLVED by the City Council of the City of National City, California, that the Mayor is hereby authorized and directed to execute, and the City Clerk is authorized to attest, that certain amendment to agreement between City of National City and State of California Department of Transportation for the construction of Plaza Boulevard offramp from I-5. PASSED AND ADOPTED this 20th day of August, 1974. OFF -RAMP RELOCATION TO 10TH ST. The CITY OF NATIONAL CITY, a body politic and a municipal corporation of the State of California, hereinafter re- ferred to as "CITY" The STATE OF CALIFORNIA, acting by and through its Business and Transportation Agency, Department of Trans- portation, hereinafter re- ferred to as "STATE" WITNESSET H: WHEREAS, a northbound off -ramp from Interstate Route 5 is presently provided to Ninth Street in National City, and WHEREAS, CITY and STATE executed an Agreement on October 24, 1972, hereinafter referred to as "AGREEMENT", setting forth C:7-26_74,p•� the terms, conditions and manner in which the terminus of the aforesaid off -ramp would be relocated from Ninth Street to Plaza Boulevard, and WHEREAS, in accord with the above referenced AGREEMENT, STATE opened contract bids on July 11, 1974, of which the lowest bid is judged to be reasonable and acceptable to STATE for purposes of award of a contract, and WHEREAS, because of the span of time since execution of the AGREEMENT and the trend of increasing construction costs during the interim, STATE'S estimated contract cost and CITY'S propor- tionate share of said costs is higher than was provided for in the AGREEMENT, and WHEREAS, because several minor changes were made by STATE in describing contract items, it is mutually deemed to be desir- able by CITY and STATE to supersede and replace "EXHIBIT A" with an up -dated "EXHIBIT A"; NOW THEREFORE, STATE and CITY mutually agree as follows: 1. That "EXHIBIT A" dated July 22, 1974, attached hereto and by this reference made a part of this Amendment to AGREEMENT, supersedes and replaces "EXHIBIT A" dated September 13, 1972, attached as part of AGREEMENT. 2. That in lieu of the provisions contained in the first para- graph of Article 6, Section II of AGREEMENT, CITY agrees to deposit with STATE within 30 days of execution of this Amendment to AGREEMENT, and upon demand therefor, the amount of $32,800.00, which figure represents the revised estimated share of construc- tion costs and construction engineering costs to be borne by CITY which are required to complete the installation referred to herein. 3. All other provisions and conditions of said AGREEMENT shall remain in full force and effect. IN WITNESS WHEREOF, the partieshereto have caused this Agree- ment to be executed by their respective officers, duly author- ized, the provisions of which Amendment are effective as of the day, month and year firsthereinabove written.
